What Is a Residual Check and How Does It Work?

A residual check is a payment you receive after the initial job is over, sent every time a film or television project you worked on is reused commercially — through reruns, streaming, home video, or foreign licensing. The obligation is created by the collective bargaining agreements that SAG-AFTRA, the Writers Guild of America, and the Directors Guild of America negotiate with producers, and it kicks in automatically whenever the work is exhibited or sold in a way that qualifies.1Directors Guild of America. Residuals Your original paycheck covered the work itself. The residual covers everything that happens with that work afterward.

Because the payment is a contractual debt rather than a bonus, it continues for as long as the project keeps generating commercial activity. That can mean a check next quarter, or a check decades from now if the show enters syndication or lands on a streaming service.

What Triggers a Residual Payment

Only certain kinds of reuse produce a residual. The main categories are:

  • Network and cable reruns after a project’s initial broadcast. Network airings typically pay more than basic cable airings of the same episode.
  • Streaming exhibition, whether on a subscription service, an ad-supported platform, or a paid download or rental service. Each uses a different formula.
  • Home video and digital sales, including physical discs, digital purchases, and electronic rentals.
  • Foreign distribution, which is collected separately through cooperation agreements with overseas societies.2SAG-AFTRA. Foreign Royalties

The size of any given check depends on the channel, the audience or subscriber base, and how the content was licensed. A prime-time network rerun pays more than a cable airing. A widely watched streaming series pays more than a niche title.

How the Amount Is Calculated

Residual formulas come in two basic shapes. Some are a percentage of the distributor’s gross receipts. Others are a percentage of what the performer originally earned. Which applies depends on the medium.

Streaming

Under the 2023 SAG-AFTRA contract, subscription streaming residuals are calculated as a percentage of the performer’s total compensation, and the percentage steps down over time. First-year domestic residuals cannot fall below 29% of applicable compensation.3SAG-AFTRA. Streaming Residuals Gains The 2023 deal also raised later-year rates: year 8 went from 8% to 10%, and years 10 through 12 each rose to 5%.4SAG-AFTRA. TV/Theatrical Contracts 2023 Summary Agreement A prior rule that let older series keep using lower rates was eliminated, so new seasons of existing series now use the updated formulas.

For high-budget content on ad-supported platforms, residuals kick in at 6% of the distributor’s gross receipts after 26 weeks of exhibition. Paid digital use (downloads, rentals, transactional platforms) uses a 3.6% rate.4SAG-AFTRA. TV/Theatrical Contracts 2023 Summary Agreement

The 2023 contract also added a streaming participation bonus: a 75% boost to residuals for any exhibition year in which a streaming show meets a viewership success threshold.3SAG-AFTRA. Streaming Residuals Gains

How the Check Actually Reaches You

Producers do not pay you directly. They send the money, along with usage data, to your union. The union checks the amount against the negotiated formula and then sends the individual payment to you.5SAG-AFTRA. Understanding the Residuals Process and FAQs In most cases a third-party payroll company handles the printing, mailing, and tax withholding.

Federal income tax is withheld from residuals as supplemental wages: a flat 22%, rising to 37% on total supplemental wages above $1 million in a calendar year.6Internal Revenue Service. 2026 Publication 15-T State withholding depends on where you live.

You do not have to receive residuals on paper. The WGA lets active members enroll in direct deposit through its PaymentHub portal, though it accepts only traditional bank accounts.7Writers Guild of America. PaymentHub Residuals Direct Deposit FAQ

When the Check Must Arrive

Producers have 15 working days from the first use of the content within a 13-week cycle to issue payment.8SAG-AFTRA. When Are Payments for Residuals Due Miss that window and late penalties accrue at $3.85 per business day, capped at $96.30 per payment. If the union files a formal claim and the producer still doesn’t pay within the response period, additional penalties can be added.9SAG-AFTRA. What Are the Penalties if My Check Is Paid Late

Late penalties do not appear on their own. In most cases the union has to file a claim before that amount is added to what you’re owed.9SAG-AFTRA. What Are the Penalties if My Check Is Paid Late

How Residuals Are Taxed

Residuals are taxable income in the year you receive them. How they are reported depends on your relationship with the production. Residuals paid while you are still treated as an employee for a given project may appear on a W-2. Residuals paid after that employment relationship has ended are generally reported on a 1099-NEC as non-employee compensation. When you receive a 1099-NEC, the income goes on Schedule C and is subject to self-employment tax (the combined Social Security and Medicare tax that self-employed workers pay, 15.3% on most income).

If you claim Social Security benefits before reaching full retirement age, residual income counted as earnings can reduce those benefits. For 2026, Social Security deducts $1 from your benefits for every $2 you earn above $24,480 if you are under full retirement age for the whole year. In the year you reach full retirement age, the reduction becomes $1 for every $3 above $65,160, counting only the months before you hit that age. Once you reach full retirement age, earnings no longer reduce benefits at any level.10Social Security Administration. Receiving Benefits While Working

The Social Security Administration excludes certain royalty income from the earnings test, specifically royalties from works you created and copyrighted before the taxable year you reached full retirement age.11Social Security Administration. SSA Handbook 1812 Whether your residuals qualify depends on the payment and your copyright ownership. Because most film and television productions are works made for hire, with the copyright held by the producer rather than the performer, this exclusion may not apply to all residual income. A tax professional or the SSA can confirm the treatment of your specific payments.

Foreign Royalties Are Separate

Many countries require compensation to performers when audiovisual works are used for cable retransmission, home copying, video rentals, and similar activities. SAG-AFTRA collects these through cooperation agreements with foreign societies and distributes them quarterly to eligible performers who have accrued at least $10.2SAG-AFTRA. Foreign Royalties

Foreign royalties follow different rules than domestic residuals. They are not subject to pension and health contributions, and you do not owe union dues on them. SAG-AFTRA deducts an administrative fee for collection and distribution.2SAG-AFTRA. Foreign Royalties

If a Check Never Arrived

Residuals are not forfeited if the union cannot find you. SAG-AFTRA holds the money in a residuals trust and releases it once you provide updated information. To claim missing payments, contact the SAG-AFTRA Residuals Department at (323) 549-6535, by email at residualtrust@sagaftra.org, or by mail. You will need your legal name, professional name, current address, union ID or Social Security number, a photo ID, and a copy of your Social Security card.12SAG-AFTRA. How to Claim Residuals

The Writers Guild runs a similar Undeliverable Funds trust. The WGA West administers it for both the East and West branches, holding payments indefinitely until the lawful recipient is located.13Writers Guild of America East. Undeliverable Residuals and Other MBA Payments

It is worth checking periodically, especially for older work that may have entered syndication or been added to a streaming platform since you last heard about it.

What Happens to Residuals After Death

Residual rights are personal property, so they pass to heirs. They can be directed by a will or trust, or, if no estate plan exists, through probate under state law.

Because the obligation is tied to commercial use of the underlying work, payments can continue long after the original recipient’s death. Most film and television projects are works made for hire, which carry a copyright term of 95 years from first publication or 120 years from creation, whichever is shorter.14Office of the Law Revision Counsel. 17 USC 302 – Duration of Copyright For as long as the work stays under copyright and gets distributed, the residual obligation stays in effect.

What Heirs Have to File

To redirect a writer’s residuals, the WGA East requires the death certificate, a copy of the will if one exists, legal documentation establishing the beneficiary (letters testamentary or a certificate of voluntary administration), a completed beneficiary affidavit, and a signed cover letter with the new beneficiary’s name, address, tax ID number, and contact information. Multiple beneficiaries also require an assignment-of-beneficiaries form.15Writers Guild of America East. Residuals Payments After Death

For SAG-AFTRA-covered work, the AFM & SAG-AFTRA Intellectual Property Rights Distribution Fund requires a completed Beneficiary Claimant Questionnaire and Application. The supporting documents depend on whether the claim runs through a will, a trust, a state’s small-estate procedure, or intestacy.16AFM & SAG-AFTRA Fund. Beneficiary Information

Payments will be held until the union or fund confirms the new recipient’s identity and legal claim, so file promptly. An estate attorney can help, particularly when several beneficiaries are involved or when the estate covers residual rights from more than one production.
