TD Provisional Credit: Timing, Investigation, and Reversals

TD Bank provisional credit is a temporary deposit the bank must put into your account when it can’t finish investigating a disputed debit card or electronic transfer within 10 business days. The credit equals the full disputed amount, you can spend it while the investigation continues, and the bank can pull it back if it later decides the transaction was legitimate. Federal law, specifically Regulation E under the Electronic Fund Transfer Act, sets the rules.

When TD Bank Must Issue Provisional Credit

The trigger is time. Once you report an error on a debit card transaction or electronic fund transfer, TD Bank has 10 business days to investigate and reach a decision. If it wraps up in that window, you get the outcome directly and no provisional credit is needed. New Accounts Get a Longer Wait

If your account is within 30 days of the first deposit, TD Bank has 20 business days rather than 10 before it has to issue provisional credit.2Consumer Financial Protection Bureau. 12 CFR 1005.11 – Procedures for Resolving Errors So new account holders may wait roughly twice as long before seeing temporary funds.

When the Bank Can Skip Provisional Credit

There’s one scenario where TD Bank doesn’t have to issue provisional credit at all. If you reported the error verbally, and the bank told you during that call that written confirmation was required and gave you the mailing address, you have 10 business days to send the letter. Miss that follow-up and the bank can withhold provisional credit and avoid liability for delays.1Office of the Law Revision Counsel. 15 USC 1693f – Notification of and Adjustment for Errors Treat the written confirmation as non-optional if the bank asks for it.

Using the Money While the Investigation Continues

Once the provisional credit posts, you can use those funds without restriction. TD Bank cannot place a hold on the credit or limit your access to it. Functionally, the money spends like any other balance in your account.

The catch is that the credit is conditional. If the investigation concludes the transaction was authorized or otherwise legitimate, the bank will reverse the credit and pull the money back out. A practical consequence: if you spend the provisional credit down and a reversal hits an already-thin account, you can end up overdrawn. Keep a cushion.

How Long the Full Investigation Takes

The maximum investigation window depends on what kind of transaction you’re disputing.

Point-of-sale covers most everyday debit card use: swipes at a store, taps at a restaurant, checkouts online. That’s the 90-day track. The 45-day track mostly covers ATM errors and direct electronic transfers between accounts.

What Happens When the Investigation Ends

The investigation closes with one of two outcomes.

Dispute Upheld

If TD Bank determines an error occurred, the provisional credit becomes permanent. The bank sends you written confirmation and you keep the money. Nothing else is required from you.

Dispute Denied

If the bank concludes the transaction was legitimate, it debits the provisional credit back out of your account. Within three business days of finishing the investigation, TD Bank must send you a written explanation of its findings, and that notice must tell you that you can request copies of every document the bank relied on.1Office of the Law Revision Counsel. 15 USC 1693f – Notification of and Adjustment for Errors Ask for those documents. If you’ve already spent the provisional credit, the reversal can push your account negative. Federal rules require TD Bank to honor checks and preauthorized transfers without charging overdraft fees for five business days after it notifies you of the reversal.2Consumer Financial Protection Bureau. 12 CFR 1005.11 – Procedures for Resolving Errors After that grace period, standard overdraft rules kick back in.

How to Report a Dispute So You Qualify

TD Bank’s customer service line is 1-888-751-9000, open 24 hours. You can also file a dispute at a branch or through online banking. Have your account number, the exact date and dollar amount, and the merchant name ready, and be specific about the reason: unauthorized transaction, duplicate charge, or wrong amount.

Deadline that matters most: you have 60 days from the date TD Bank sends the statement first showing the disputed transaction. What Isn’t Covered

Two common situations fall outside these rules and don’t get provisional credit the way debit disputes do.

Credit card charges. If the disputed charge is on a TD Bank credit card, a different law applies: the Fair Credit Billing Act, implemented through Regulation Z. You submit the dispute in writing to the billing inquiry address within 60 days of the statement, the creditor acknowledges within 30 days, and resolution comes within two billing cycles with an outside limit of 90 days. There’s no provisional credit because you never lost the money in the first place. Business accounts. Regulation E only covers accounts held primarily for personal, family, or household purposes. Disputes on TD Bank business checking or savings accounts don’t get provisional credit, the 10-day trigger, or the 45/90-day investigation caps.6Consumer Financial Protection Bureau. If the Bank Denies Your Dispute

Start with the documents. Request everything TD Bank relied on and read it closely. Banks sometimes deny claims on records that look legitimate on the surface but have a straightforward explanation you can supply.

If you believe the denial was wrong, you can file a complaint with the Consumer Financial Protection Bureau at consumerfinance.gov/complaint. Include dates, amounts, and any correspondence with the bank. Companies generally respond within 15 days, though complex cases can run up to 60.7Consumer Financial Protection Bureau.
