A sample letter to remove a name from a mortgage is a short, businesslike request to your loan servicer asking for a release of liability for one borrower, tied to an assumption, a refinance, or a sale of the property. The letter itself doesn’t take anyone off the loan. It opens a file, and the lender then decides based on whether the remaining borrower can carry the debt alone. Getting the letter right, with the right attachments sent the right way, is what moves the request from a customer service inbox into underwriting.
One thing to settle before you write: signing a quitclaim deed transfers ownership but leaves the mortgage debt exactly where it was. The letter below addresses the debt side, which is the side the lender controls.
What the Letter Needs to Contain
Keep it to one page. The letter’s job is to give the servicer everything needed to locate your account and route the request, not to argue your case. Include:
- Full legal names, mailing addresses, phone numbers, and email addresses for both the departing and the remaining borrower.
- The mortgage account number and the full property address.
- The current servicer’s name and mailing address. Send to the servicer shown on your monthly statement, which may not be the original lender.
- The specific action you’re requesting: an assumption review, a release of liability tied to a refinance, or information about the servicer’s process for removing a borrower.

Documents to Attach
The right paperwork moves your request from a general inquiry into something the servicer can act on. What you send depends on why the transfer is happening and which path you’re pursuing.
- Divorce decree or separation agreement. The court order establishing which party keeps the property and the mortgage obligation is the single most important attachment in divorce-related requests.
- Quitclaim or warranty deed. Either proof that ownership has already been transferred, or a draft ready to execute.
- Financial documentation for the remaining borrower. Recent pay stubs, tax returns, and bank statements. The lender will need these for underwriting eventually, and including them up front can shorten the timeline.
- Proof of refinance closing. If you’ve already refinanced into a new loan, include the closing disclosure or payoff confirmation for the old one.

How to Send It and What Happens Next
Send the letter by certified mail with return receipt requested. The receipt is your proof of when the servicer received the request, which matters if you later need to challenge a delayed response. A secure servicer portal that accepts document uploads works too, but save the upload confirmation.
Expect the servicer’s first response to be an application packet or a list of required documents rather than a decision. Once the servicer treats your request as a credit application for an assumption or refinance, federal law requires it to notify you of the decision within 30 days after it has all the information it normally considers.2Consumer Financial Protection Bureau. 1002.9 Notifications That clock starts when the application is complete, not the day you mailed the letter. If three to four weeks pass with no response, call the servicer, reference the certified mail tracking number, and ask for a written status update.
What the Letter Can Actually Accomplish
Lenders won’t cross a name off a loan on request. They underwrote the mortgage based on both borrowers’ combined finances, and removing one changes the risk. Your letter has to point toward one of three mechanisms.
Refinancing
The remaining borrower applies for a new loan in their name alone, and the proceeds pay off the joint mortgage. When the old loan closes, the departing borrower’s obligation ends. Refinancing involves a fresh application, credit check, and appraisal, plus closing costs that typically run 2 to 5 percent of the loan balance.3Fannie Mae. Loan Assumption
An assumption lets the remaining borrower take over the existing mortgage under its current terms, keeping the original interest rate. That’s valuable when the existing rate is well below what a refinance would offer. Government-backed loans are far more likely to allow it than conventional ones. VA-guaranteed loans work similarly. The loan must be current, the assumer must be creditworthy under VA standards, and the assumer must accept full liability for the debt. Lenders with automatic authority can charge a processing fee of up to $300, and assumptions requiring VA prior approval are capped at $250. A funding fee of 0.5 percent of the remaining balance also applies at closing unless the assumer is exempt.5U.S. Department of Veterans Affairs. Conventional mortgages backed by Fannie Mae generally include due-on-sale provisions, and servicers are expected to accelerate the debt when ownership transfers unless the transfer fits a specific exemption.6Fannie Mae. Sale of the Property
Selling the home to a third party and paying off the mortgage from the proceeds ends both borrowers’ obligations automatically. It’s the cleanest exit when neither borrower can qualify alone, though obviously neither person keeps the home.
If the Lender Denies the Request
Lenders are not required to approve a release of liability. If the remaining borrower can’t show enough income or credit strength to carry the loan alone, the answer will be no. Even FHA loans, which require release after a qualified assumption, still demand that the new borrower meet underwriting standards first.7U.S. Department of Houseiveness and Urban Development. If an assumption falls through, refinancing is a separate underwriting process with different qualifying criteria and may still succeed. If neither borrower can carry the mortgage alone, selling the property and paying off the loan may be the only realistic way to end the departing borrower’s liability. In divorce cases, the court order may set a deadline for refinancing or sale, so a denial letter isn’t something to sit on.
