Removing Your Name From a Joint Mortgage: Refinance, Assume, or Sell

To remove a name from a joint mortgage, you need the lender to release that borrower from the loan, which almost always means refinancing into a new loan in one name, having the remaining borrower formally assume the existing loan, or selling the home and paying the loan off. A quitclaim deed by itself will not do it. Learning how to remove a name from a joint mortgage starts with that distinction, because the deed controls ownership while the mortgage controls the debt, and the two must be handled separately.

Why a Quitclaim Deed Alone Won’t Work

Signing a quitclaim deed transfers one person’s ownership interest in the property to the other. It does nothing to the loan. The departing person stays fully liable for every payment until the lender formally releases them, and if payments stop, the lender will come after both borrowers no matter what the deed says or what a divorce decree promised.

A quitclaim deed is still part of the process, just not the whole of it. Once the mortgage side is resolved through a refinance, an assumption, or a sale, the departing borrower signs the deed to transfer ownership and it gets recorded with the county. Divorcing couples get one specific protection here. Refinancing Into One Borrower’s Name

Refinancing is the most straightforward option. The remaining borrower applies for a new loan on their own, and the proceeds pay off the original joint mortgage in full. That payoff is what actually severs the departing borrower’s obligation. From there, only the remaining borrower appears on the loan and, after the quitclaim, on the title.

The hard part is qualifying on one income where two used to be enough. The lender underwrites the application from scratch, and if rates have climbed since the original loan, the new monthly payment can be noticeably higher. Less income plus a worse rate is where a lot of people stall out.

Closing costs also apply. They usually run 2% to 6% of the loan amount once you include lender fees, appraisal, title insurance, and prepaid escrow items. On a $300,000 loan that is $6,000 to $18,000, though many lenders will let you roll the costs into the new balance. If a divorce or separation is behind the refinance, the agreement should say who pays.

Assuming the Existing Loan

An assumption lets one borrower take over the current mortgage without opening a new one. The rate and remaining balance stay put, which matters when today’s rates sit above the rate on the old loan. The lender reviews the assuming borrower’s credit and finances and, if approved, releases the departing borrower.

FHA Loans

All FHA-insured mortgages are assumable. The lender or servicer applies standard mortgage underwriting to the assuming borrower and must finish that review within 45 days of receiving the required documents. VA Loans

VA-guaranteed loans are built around assumability. The VA requires that the loan be current, that the assuming borrower meet VA underwriting standards, and that the assumer accept full liability for the loan.3Department of Veterans Affairs. One boundary to be aware of: if the person assuming the loan is not an eligible veteran who substitutes their own entitlement, the original veteran’s entitlement stays tied to the loan until it is paid off, which can block the veteran from using the VA benefit on another home.3Department of Veterans Affairs. Conventional Loans

Most conventional loans include a due-on-sale clause and are not freely assumable. Selling the Property

If refinancing is out of reach and the loan can’t be assumed, selling is the clean exit. The sale pays off the mortgage and closing costs, and whatever is left is divided per the co-owners’ agreement or ownership shares. Both borrowers walk away from the debt. This works when there is enough equity to cover the payoff and sale expenses; if the home is underwater, the co-owners may need to bring cash to closing or negotiate a short sale, which requires lender approval and can hurt both borrowers’ credit.

What the Remaining Borrower Has to Qualify With

Whether the plan is a refinance or an assumption, the lender needs proof the remaining borrower can carry the loan alone. Three numbers do most of the work.

Income

Expect to hand over recent pay stubs, W-2s, and typically two years of tax returns. Self-employed applicants should be ready with profit-and-loss statements and possibly business returns. Alimony or child support usually counts as income if you can document it and show it is likely to continue for at least three years.

Credit Score

For a conventional refinance, Fannie Mae’s minimum score starts at 620 through automated underwriting. Debt-to-Income Ratio

Add up the future mortgage payment (with taxes and insurance), car loans, student loans, minimum credit card payments, and other monthly obligations, then divide by gross monthly income. Appraisal

The lender will order a new appraisal to confirm the home’s current value. A low appraisal can shrink the equity available for the refinance or kill the deal outright. The appraisal costs a few hundred dollars and is the borrower’s responsibility.

Why Waiting Is a Credit Risk

While your name stays on the loan, every late payment lands on your credit report too. It doesn’t matter who agreed to pay or what any decree says. If the other borrower misses payments or stops paying, your score falls with theirs, and that damage can make it harder to get a car loan, a credit card, or your own future mortgage for years.

This is why speed matters. A divorce decree assigning the mortgage to your ex does not protect your credit. Only a refinance payoff, a formal lender release through assumption, or a sale actually ends your liability.

When the Other Borrower Won’t Cooperate

The available remedies depend on whether you were married.

After a Divorce

A divorce decree can order one spouse to refinance and remove the other’s name by a set deadline. If your ex ignores it, you can file a motion for contempt with the court that issued the decree. The judge can impose fines, order the property sold, or impose other sanctions. Many divorce agreements also include indemnification language holding the non-compliant spouse responsible for credit damage and costs caused by their refusal.

A court cannot force a lender to approve a refinance, though. If the ex’s finances have slipped to the point they can’t qualify, the court may end up ordering a sale.

Unmarried Co-Owners

Without a divorce decree, the main tool is a partition action, a lawsuit asking the court to divide the property or force its sale. Unless the co-owners waived partition rights in a binding agreement, this right is generally absolute. The court can order a sale at fair market value, with proceeds paying off the mortgage and the remainder split by ownership share. Partition suits involve attorney fees and can take months, but they end a stalemate.

Tax Points to Know Before You Transfer

Transfers of property between spouses or former spouses as part of a divorce are generally tax-free under federal law. No taxable gain or deductible loss is recognized, and the person keeping the property takes over the original tax basis. Unmarried co-owners face a different picture. Transferring an equity interest to someone who isn’t a spouse or former spouse can bring gift tax rules into play. The Sequence of Steps

For a refinance or assumption, the process usually runs in this order:

  • Contact the mortgage servicer, tell them you want to remove a borrower, ask whether the loan is assumable, and get their requirements in writing.
  • Gather financial documents for the remaining borrower: pay stubs, W-2s, tax returns, bank statements, and authorization for a credit check. Government-backed assumptions require documentation similar to a purchase loan.
  • Submit the application. For a refinance, shop several lenders. For an assumption, work through the existing servicer.

  • Close. A refinance produces a new loan agreement. An assumption produces a formal release of liability for the departing borrower.

Most refinances close in 30 to 60 days, longer if appraisal or underwriting hits problems. Keep every mortgage payment current during the process. A late payment now hurts the remaining borrower’s chances of qualifying and damages both borrowers’ credit at exactly the wrong moment.
