Is My Financial Advisor a Fiduciary? Verify in Five Minutes

To find out whether your financial advisor is a fiduciary, check how they’re registered rather than what their title or business card says. Registered Investment Advisers and their representatives owe you a legal fiduciary duty under the Investment Advisers Act of 1940. Brokers, insurance agents, and professionals who hold both licenses often operate under weaker standards that apply only at the moment of a recommendation. You can confirm the answer for free in about five minutes using the SEC’s public databases and a few direct questions.

What Fiduciary Duty Actually Means

A fiduciary advisor owes you two things: a duty of care and a duty of loyalty. Care means the advice reflects a real understanding of your finances, goals, and risk tolerance. Loyalty means the advisor cannot put their own compensation, or their firm’s revenue, ahead of your interests, and must disclose and manage any conflicts of interest in your favor.1SEC.gov. These duties are continuous. They apply for the entire length of your relationship, not just when a specific product is being sold. If your allocation drifts or your life circumstances change, a fiduciary is expected to notice and adjust.

Who Is a Fiduciary and Who Isn’t

Registered Investment Advisers and Their Representatives

Registered Investment Advisers (RIAs) are the clearest case. These firms register with either the SEC or a state securities regulator and are bound to act as fiduciaries under Section 206 of the Investment Advisers Act of 1940.1SEC.gov. Firms with $110 million or more in assets under management generally must register with the SEC; smaller firms register with their state.2SEC.gov. RIAs usually charge a percentage of assets under management rather than commissions on product sales, tying their income to your portfolio’s growth instead of transaction volume. “Fee-only” means the advisor takes no commissions, referral fees, or other third-party payments at all.

Certified Financial Planners

Anyone holding the CFP designation is bound by the CFP Board’s Code of Ethics, which explicitly requires fiduciary duty when providing financial advice.3CFP Board. Code of Ethics and Standards of Conduct This is an ethical and contractual obligation enforced by the Board, sitting on top of whatever regulatory standard applies to how the person is registered. A CFP who also works as a broker still owes fiduciary duty under the Board’s rules.

Robo-Advisors

Automated investment platforms that register with the SEC as investment advisers owe you the same fiduciary duty as any human advisor. The SEC has said so explicitly.1SEC.gov. Commission Interpretation Regarding Standard of Conduct for Investment Advisers The catch is practical: a robo-advisor knows only what you told it during onboarding. If your circumstances have changed and you haven’t updated your profile, the algorithm doesn’t know.

Brokers and Insurance Agents

Brokers work under Regulation Best Interest (Reg BI). It requires them to act in your best interest at the time they make a recommendation, but does not impose the continuous obligation a fiduciary carries.4Legal Information Institute. Insurance agents selling annuities operate under a separate framework. The National Association of Insurance Commissioners revised its model regulation in 2020 to require annuity recommendations be in the consumer’s best interest, and about 40 states have adopted the revisions.6NAIC. Annuity Suitability and Best Interest Standard This “best interest” standard is not the same as fiduciary duty; the enforcement mechanisms and ongoing obligations differ.

The Dual-Registration Trap

Most reader confusion lives here. Many professionals hold licenses as both an investment adviser representative and a broker-dealer representative. When managing your fee-based advisory account they act as a fiduciary. When selling you an insurance product or a loaded mutual fund for a commission, they may be operating under Reg BI instead. The standard of care can shift mid-conversation, and clients rarely notice.

The label “fee-based” (as opposed to “fee-only”) is usually the tell. A fee-based advisor charges advisory fees and can also earn commissions on certain products. A fee-only advisor is paid exclusively by clients and accepts no commissions or third-party payments. One word, very different exposure to conflicts of interest.

How to Verify in About Five Minutes

Check the SEC’s Investment Adviser Public Disclosure Database

The fastest verification is at adviserinfo.sec.gov. Enter the firm’s name or CRD number and pull up its registration records.7Investment Adviser Public Disclosure. If the firm is registered as an investment adviser, it owes you fiduciary duty. The brochure also lists disciplinary actions and legal issues from the preceding ten years.8SEC.gov. Read the Form CRS Relationship Summary

Every SEC-registered investment adviser and broker-dealer must give retail investors a Form CRS, a standardized document of up to two pages that describes the relationship, the fees, and the applicable standard of conduct.9SEC.gov. Investment advisers must deliver Form CRS before or at the time you sign an advisory contract. Broker-dealers must deliver it before making a recommendation, placing an order, or opening an account. If you haven’t received one, ask. Reluctance to produce it is a red flag.

Use FINRA BrokerCheck

If your professional works as a broker or holds dual registrations, FINRA’s BrokerCheck at brokercheck.finra.org lets you search by name or CRD number for employment history, licensing, and any regulatory actions or customer disputes.11FINRA. About BrokerCheck If the profile shows the person registered as an Investment Adviser Representative, they’re associated with a fiduciary firm. If it shows only broker-dealer registrations, fiduciary duty does not apply to their securities recommendations. Ask Directly, and Get It in Writing

Database checks confirm registration, but they don’t always show how a dual-registered professional intends to work with you day to day. Ask plainly:

  • Will you act as a fiduciary for all advice you give me? The answer you want is an unqualified yes, not “when I’m acting in my advisory capacity” or something similarly hedged.
  • How are you compensated? Fee-only means client-paid fees exclusively. Commissions or third-party payments mean you are not getting pure fiduciary service on those transactions.
  • What are the total costs I’ll pay? A fiduciary should give a clear, complete answer covering both their fee and the underlying investment costs.

A legitimate fiduciary will not get defensive about these questions. If the advisor commits to acting as a fiduciary at all times, ask them to confirm it in writing. An advisor who balks at documenting what they just said out loud is telling you something worth hearing.

A Caveat for Retirement Accounts

If your main concern is a 401(k), IRA, or other retirement account, the picture is less settled. The Department of Labor’s Retirement Security Rule would have required anyone providing investment advice on retirement accounts to give prudent, loyal advice and manage conflicts of interest.13U.S. Department of Labor. Retirement Security Rule: Definition of an Investment Advice Fiduciary Federal courts suspended the rule, and as of early 2026 the DOL has dropped its appeal. A revised version has appeared on the department’s regulatory agenda, but the rule remains inactive.

For now, the older, narrower ERISA definition of fiduciary applies to employer-sponsored retirement plans, and IRA rollovers or annuity recommendations inside retirement accounts may only be subject to Reg BI or the NAIC best interest standard depending on who is advising you. If a broker recommends rolling your 401(k) into an IRA, ask explicitly what standard of care governs that recommendation.

If a Fiduciary Breaks the Duty

If a registered investment adviser has violated its fiduciary obligations, you can submit a tip, complaint, or referral through the SEC’s online reporting system. The SEC’s Division of Enforcement investigates misconduct by investment advisers and broker-dealers and can bring administrative proceedings resulting in disgorgement, civil penalties, and suspension or revocation of registration.14U.S. Securities and Exchange Commission. For disputes involving broker-dealers or dual-registered professionals, FINRA operates a mandatory arbitration process. Most brokerage account agreements include an arbitration clause, so a dispute typically goes to FINRA rather than court. You file a Statement of Claim describing the dispute and damages sought, a Submission Agreement, and a filing fee, and the resulting decision is binding on both sides.15FINRA.org. One legal point worth knowing: the Investment Advisers Act of 1940 does not give investors a private right of action for fiduciary breach under the Act itself. Successful claims usually rely on related theories such as negligence or federal securities fraud. For larger losses, talking to an attorney who handles securities disputes before filing is worth the cost.
