Credit card debt is dischargeable in bankruptcy in the great majority of cases. Because credit card balances are unsecured, both Chapter 7 and Chapter 13 can eliminate your personal obligation to repay them, and once the court issues the discharge order the creditor can no longer call, sue, or collect on the balance.1United States Courts. When Credit Card Debt Cannot Be Wiped Out

The Bankruptcy Code carves out a few situations where a credit card balance survives the discharge. Luxury Purchases in the 90 Days Before Filing

If you charge more than $900 to a single credit card for luxury goods or services within 90 days before filing, that portion of the balance is presumed non-dischargeable.3Federal Register. Cash Advances in the 70 Days Before Filing

Cash advances totaling more than $1,250 from any open-end credit plan within 70 days before filing trigger the same presumption.3Federal Register. Adjustment of Certain Dollar Amounts Applicable to Bankruptcy Cases These dollar amounts are adjusted periodically by the Judicial Conference, and the current figures took effect on April 1, 2025.

Actual Fraud

A creditor can also challenge any charge on the basis of actual fraud, without regard to timing or dollar amount. Lying about your income on the credit application or using someone else’s identity to open the account would fall in this category.2Office of the Law Revision Counsel. 11 U.S. Code 523 – Exceptions to Discharge Here the creditor has to actually prove the fraud rather than relying on a presumption.

How a Creditor Blocks Discharge

A credit card company that thinks a balance should not be discharged cannot simply refuse to honor the order. It has to file a formal lawsuit inside the bankruptcy case, called an adversary proceeding, within 60 days after the first date set for the meeting of creditors.4Office of the Law Revision Counsel. 11 USC App Rule 4007 – Determination of Dischargeability of a Debt Miss the window, and the debt is discharged with everything else.

If your recent spending falls inside the luxury or cash-advance thresholds, the creditor only needs to show the timing and the dollar amount, and it is on you to explain that the charges were not abusive. In practice, most issuers do not file these proceedings unless the amounts are substantial, because the legal costs of pursuing them often exceed what they would recover.

What Happens in Chapter 7

Chapter 7 is the fastest route. The court typically issues the discharge 60 to 90 days after the first meeting of creditors, and the meeting itself happens about a month after filing, so the whole process usually runs four to six months.5United States Courts. Chapter 7 – Bankruptcy Basics

A trustee reviews your assets to see whether any non-exempt property can be sold to pay creditors. Most consumer Chapter 7 cases are “no-asset” cases, where exemption laws protect everything you own. In those cases, credit card companies receive nothing and the balances are erased in full.

What Happens in Chapter 13

Chapter 13 works through a repayment plan lasting three to five years.6United States Courts. Chapter 13 Bankruptcy Basics Each month you pay your disposable income to a trustee, who distributes it to creditors according to a priority system.

Credit card balances sit at the bottom of that priority system as general unsecured debt. Secured debts like mortgages and car loans get paid first, then priority debts like recent taxes and domestic support. Whatever is left goes to unsecured creditors, so credit card issuers often receive only a fraction of what you owed. Co-Signers Are Not Protected the Same Way

A discharge eliminates your personal liability, not the debt itself. If someone co-signed on your account, the creditor can still pursue them for the full balance.7Office of the Law Revision Counsel. 11 U.S. Code 524 – Effect of Discharge This catches many filers off guard when a parent or spouse is on the account.

Chapter 13 offers more protection here. As soon as you file, a co-debtor stay kicks in automatically and blocks creditors from pursuing anyone who is liable with you on a consumer debt.8Office of the Law Revision Counsel. 11 U.S. Code 1301 – Stay of Action Against Codebtor The stay lasts for the life of the case, though a creditor can ask the court to lift it. If your plan pays the debt in full, the co-signer is permanently free of it. Chapter 7 has no equivalent, so creditors can go after co-signers immediately.

You Do Not Owe Taxes on the Discharged Balance

Canceled debt outside of bankruptcy is usually treated as taxable income. If a card issuer forgives $15,000 through a settlement, the IRS ordinarily counts that as $15,000 of income to you. Bankruptcy is treated differently.
