If your husband forged your signature on his 401(k) paperwork, you are looking at both a federal crime and a transaction that can be reversed. Your first three moves are the same regardless of the amount: notify the plan administrator in writing, hire an attorney who handles ERISA cases, and file a police report for forgery. Federal law gives a spouse specific rights over a 401(k), and the penalties for forging spousal consent are serious.
Why Your Signature Mattered in the First Place
The Employee Retirement Income Security Act of 1974 (ERISA) governs private employer-sponsored retirement plans, including 401(k)s.1U.S. Department of Labor. Employee Retirement Income Security Act (ERISA) Under those rules, a surviving spouse is automatically entitled to the full death benefit from a 401(k), and your husband cannot name a different beneficiary without your written consent.
Whether your consent was also required for a withdrawal depends on how the plan is written. Plans that pay benefits as an annuity must follow “qualified joint and survivor annuity” rules, which require your written consent before any distribution.2Office of the Law Revision Counsel. 26 USC 401 – Qualified Pension, Profit-Sharing, and Stock Bonus Plans Many 401(k)s are structured as profit-sharing plans and are exempt from that particular consent requirement, provided the surviving spouse still receives the full death benefit and no annuity option was elected.3Internal Revenue Service. Fixing Common Plan Mistakes – Failure to Obtain Spousal Consent When consent is required, it has to be in writing and witnessed by either a plan representative or a notary.4eCFR. 26 CFR 1.401(a)-20 – Requirements of Qualified Joint and Survivor Annuity A prenuptial agreement does not substitute for it.
This distinction matters for how you frame your claim. If your consent was required and he forged it, the plan processed a distribution that was never authorized. If the plan didn’t require consent for that specific withdrawal but he forged your signature on a beneficiary change, the change form is still invalid. Either way, the forgery is illegal.
Build Your File Before You Make a Call
Write down a timeline first: when you noticed something wrong, the date of the transaction, and any conversations you had with your husband about the account before or after.
You have a federal right to request copies of plan documents from the 401(k) administrator, including the withdrawal or loan application carrying the forged signature.5U.S. Department of Labor. Plan Information Send that request in writing so you can prove you made it. The administrator must provide copies either free or at a reasonable copying fee.
Pull account statements showing the balance before the transaction. Pull bank records that might show where the money went. Save texts, emails, and voicemails. If your husband admitted anything about the withdrawal in writing, that can be decisive.
Who to Notify, and in What Order
The Plan Administrator
Call the plan administrator, then follow up the same day with a certified letter. State that a withdrawal was processed using a forged signature, that you did not consent, and that you are requesting an investigation and restoration of the funds. Keep it factual: transaction date, amount, and a request for every document related to the distribution.
The administrator owes a fiduciary duty to plan participants and beneficiaries. If your consent was required and the administrator processed the distribution on a forged form, the administrator may share liability. Good-faith reliance on what looked like a valid consent gives limited protection, not blanket immunity, once fraud is on the table.
An ERISA Attorney
ERISA litigation is specialized. You want an attorney who regularly handles retirement plan disputes, not a general family lawyer. An ERISA attorney can read the plan’s actual consent requirements, evaluate whether the administrator failed in its duties, and file suit if needed. Federal law lets a plan participant or beneficiary sue to recover benefits, enforce plan rights, or seek relief for fiduciary breaches.6Office of the Law Revision Counsel. 29 USC 1132 – Civil Enforcement
Local Police
Forging a signature is a crime in every state. File a report for forgery, and identity theft if it fits. Local police may not investigate a retirement plan matter aggressively, but the report itself matters: plan administrators and financial institutions routinely require a police report number before opening their own fraud investigation.
The Department of Labor

Request Assistance from a Benefits Advisor An EBSA investigation can lead to the Department of Labor suing to restore stolen funds and referring the case to federal prosecutors.
The Tax Trap on a Joint Return
A fraudulent 401(k) withdrawal creates a tax problem people rarely see coming. The plan will issue a Form 1099-R reporting the distribution as taxable income to the account holder. If you filed a joint return with your husband for that year, you can be jointly liable for the tax.
The tax code does not treat fraud or theft as an exception to the 10% early withdrawal penalty on distributions taken before age 59½.9Office of the Law Revision Counsel. 26 USC 72 – Annuities; Certain Proceeds of Endowment and Life Insurance Contracts If he was under 59½, the distribution can trigger regular income tax plus the 10% penalty, and both can land on a joint return you signed.
If the plan restores the funds, the tax issue often resolves through a corrected 1099-R. If restoration is slow, protect yourself by filing IRS Form 8857 for innocent spouse relief, which can separate your liability from his. You qualify when the joint return understated tax due to errors you didn’t know about, and the IRS also recognizes an exception for domestic abuse victims who signed under pressure.10Internal Revenue Service. Innocent Spouse Relief Form 8857 has to be filed within two years of receiving an IRS notice of tax due tied to the return.
What Restoration and Prosecution Look Like
If the administrator’s investigation confirms the forgery, the plan may be obligated to put the money back. That is clearest where your consent was required and the administrator processed the transaction without valid authorization. Restoration is not limited to the raw dollar amount. Under the Department of Labor’s correction framework, the plan must account for lost earnings, calculated using daily compounding at IRS underpayment rates.11U.S. Department of Labor. Voluntary Fiduciary Correction Program (VFCP) Online Calculator Market gains during the period the money was gone should also be restored.
Stealing from a retirement plan is a federal crime. Anyone who embezzles or steals assets from an ERISA-covered plan faces up to five years in prison, a fine, or both.12Office of the Law Revision Counsel. 18 USC 664 – Theft or Embezzlement From Employee Benefit Plan EBSA regularly refers cases to the U.S. Attorney’s Office.7U.S. Department of Labor. These prosecutions happen. Deadlines You Cannot Miss
ERISA sets hard time limits. You can bring a fiduciary breach suit within three years of gaining actual knowledge of the violation, or six years from when the breach occurred, whichever comes first.15GovInfo. 29 USC 1113 – Limitation of Actions Where the breach involves fraud or concealment, you get up to six years from the date you actually discovered it. A forged signature is concealed by definition, so that exception often applies here.
For innocent spouse relief, the IRS clock is two years from receiving a notice of audit or tax due tied to the return.10Internal Revenue Service. Innocent Spouse Relief Don’t wait for the notice to talk to a tax professional. The sooner you report the forgery, the stronger your position on both restoration and any lawsuit.
If Divorce Is Coming
A forged withdrawal is powerful evidence in a property division. A family court can issue a Qualified Domestic Relations Order (QDRO), directing the plan to pay a portion of the account directly to you as the former spouse.16U.S. Department of Labor. QDROs – An Overview FAQs Distributions to you under a QDRO are also exempt from the 10% early withdrawal penalty, even if you are under 59½.9Office of the Law Revision Counsel. 26 USC 72 – Annuities; Certain Proceeds of Endowment and Life Insurance Contracts
A judge can account for the wrongfully withdrawn funds when dividing marital property. In practice, that can mean you receive a larger share of the remaining assets. If the money has already been restored through the administrator’s investigation, the QDRO simply divides the full account. If it hasn’t, your attorney can argue that the missing funds should be credited to your share of the marital estate. Even if divorce is not on the table today, consulting a family law attorney alongside your ERISA attorney is worth doing, since financial deception at this level rarely stands alone.
