How to Get Rid of Student Loan Debt Without Paying?

There are a handful of legitimate ways to get rid of student loan debt without paying the full balance: qualify for a federal forgiveness or discharge program tied to your job, your repayment history, a disability, or misconduct by your school, or, in narrower cases, discharge the debt in bankruptcy. Each path has its own eligibility rules, and starting in 2026 the tax treatment of forgiven debt matters as much as qualifying for the program itself.

Almost every option below applies to federal student loans only. Private loans have one route out short of repayment, and that’s bankruptcy.

Forgiveness Through Public Service Work

Public Service Loan Forgiveness cancels the remaining balance on your Direct Loans after 120 qualifying monthly payments — roughly 10 years — while you work full-time for a federal, state, local, or tribal government agency or a tax-exempt nonprofit.1eCFR. 34 CFR 685.219 – Public Service Loan Forgiveness Program Full-time AmeriCorps and Peace Corps service counts too.

Only Direct Loans qualify — Direct Subsidized, Direct Unsubsidized, Direct PLUS, and Direct Consolidation.1eCFR. 34 CFR 685.219 – Public Service Loan Forgiveness Program If you have older FFEL or Perkins Loans, you need to consolidate them into a Direct Consolidation Loan first, but be aware that consolidating resets your qualifying payment count to zero.2Federal Student Aid. Payments must be made under a qualifying plan. Income-driven repayment plans and the 10-year Standard Plan both count, though the Standard Plan typically leaves nothing to forgive at the 120-payment mark unless you had qualifying deferment or forbearance periods.3Federal Student Aid. What Repayment Plans Qualify for Public Service Loan Forgiveness For most borrowers, an IDR plan produces a smaller monthly payment and a real balance left to forgive.

Forgiveness After 20 or 25 Years of Income-Driven Payments

If you don’t work in public service, income-driven repayment plans set your monthly payment based on income and family size, and forgive any remaining balance after 20 or 25 years.6Consumer Financial Protection Bureau. Student Loan Forgiveness The timeline varies by plan:

  • Pay As You Earn (PAYE): 20 years for all eligible loans.
  • Income-Based Repayment (IBR): 20 years if you first borrowed on or after July 1, 2014; 25 years otherwise.
  • Income-Contingent Repayment (ICR): 25 years.

FFEL and Perkins Loans have to be consolidated into a Direct Loan before you can enroll in most IDR plans.

The big change for anyone counting on IDR forgiveness is tax treatment. The American Rescue Plan temporarily shielded student loan forgiveness from federal income tax, but that provision expired on December 31, 2025.5Office of the Law Revision Counsel. 26 U.S. Code 108 – Income From Discharge of Indebtedness If your IDR balance is forgiven in 2026 or later, the canceled amount is generally added to your taxable income for that year, which can produce a substantial tax bill.

Discharge Based on Total and Permanent Disability

If a severe disability prevents you from working, you can have your federal student loans fully discharged. You qualify through documentation from one of three sources: the Department of Veterans Affairs, the Social Security Administration, or a licensed medical professional such as a physician, nurse practitioner, physician assistant, or certified psychologist.7eCFR. 34 CFR 685.213 – Total and Permanent Disability Discharge

Veterans need VA documentation showing they were determined unemployable due to a service-connected disability. SSA recipients need a Notice of Award or Benefits Planning Query showing SSDI or SSI based on disability and a next review scheduled five to seven years out. A qualifying medical provider can also certify that you are totally and permanently disabled.7eCFR. 34 CFR 685.213 – Total and Permanent Disability Discharge

You can apply through StudentAid.gov or by mailing, faxing, or uploading a completed form. In some cases the Department will grant the discharge automatically after receiving qualifying data directly from the VA or SSA.8Federal Student Aid. Total and Permanent Disability Discharge

If your discharge is based on SSA documentation or a medical provider’s certification, you enter a three-year post-discharge monitoring period. Taking out a new federal student loan or TEACH Grant during that window reverses the discharge and reinstates your debt. Veterans discharged through VA documentation don’t go through any monitoring period.

Discharge When Your School Misled You

If your school made false or deceptive statements to get you to enroll — about job placement rates, whether credits would transfer, program quality, or similar material claims — you can file a borrower defense to repayment claim to have the connected loans discharged.9eCFR. 34 CFR 685.206 – Borrower Responsibilities and Defenses You have to show the school misrepresented something material and that you were financially harmed.

The legal standard depends on when your loans were first disbursed. Loans disbursed before July 1, 2017 are evaluated under applicable state law. Loans disbursed between July 1, 2020 and July 1, 2023 require you to prove the misrepresentation by a preponderance of the evidence.9eCFR. 34 CFR 685.206 – Borrower Responsibilities and Defenses Regardless of period, evidence such as promotional materials, enrollment agreements, emails, and records of employment outcomes strengthens the claim.

You file with the Department of Education, which notifies the school and gives it at least 60 days to respond. Your loans go into forbearance while the claim is under review. If approved, the Department discharges the remaining balance on the affected loans and may refund payments you already made.10Federal Student Aid. Borrower Defense Loan Discharge Reviews can take months or years, particularly when many students filed against the same school.

Discharge When Your School Closed

If your school closed while you were enrolled — or if you withdrew within 180 days before the closure date — you can have your federal loans for that program fully discharged.11eCFR. 34 CFR 685.214 – Closed School Discharge The Department can extend that 180-day window in exceptional circumstances. You don’t qualify if you completed the program through a teach-out at another school or by transferring your credits to a comparable program.

Often you don’t need to apply. The Department automatically discharges qualifying loans one year after the closure date if its records show you were enrolled and didn’t complete elsewhere. You can also submit an application rather than wait, using closure dates from the Department’s Closed School Search page to confirm eligibility.

A successful closed school discharge eliminates the full balance, entitles you to a refund of payments already made on those loans, and removes the debt from your credit record.

Discharging Student Loans in Bankruptcy

Student loans aren’t automatically wiped out in bankruptcy the way most consumer debts are. You have to prove that repaying them would impose an “undue hardship” on you and your dependents.12Office of the Law Revision Counsel. 11 U.S. Code 523 – Exceptions to Discharge The bar is high, but not impossible.

Most federal courts use the Brunner test, which requires three findings:

  • Current inability to pay: your income and expenses do not allow you to maintain a minimal standard of living while repaying.
  • Persistence: that situation is likely to continue for a significant portion of the repayment period.
  • Good faith: you made genuine efforts to repay before seeking discharge.

Courts in the First and Eighth Circuits use a broader “totality of the circumstances” test that weighs past, present, and reasonably foreseeable resources against necessary expenses and other relevant facts.

Since November 2022, the Department of Justice has used an attestation-based process in these cases. A borrower filing an adversary proceeding submits a sworn statement about their finances, and DOJ attorneys use it to decide whether to consent to discharge rather than litigate. It applies in both Brunner and totality jurisdictions.

To start, you file an adversary proceeding — a separate lawsuit inside your bankruptcy case — and serve the loan servicer and the Department of Education. A bankruptcy judge reviews the evidence at a hearing, and if the undue hardship standard is met, a court order eliminates your obligation to repay. Individual Chapter 7 and Chapter 13 debtors are generally exempt from the $350 adversary proceeding filing fee.13United States Courts. What You’ll Owe the IRS When Debt Is Forgiven

The tax treatment of canceled student debt depends on the program, and getting it wrong can mean a surprise tax bill in the thousands or tens of thousands.

PSLF forgiveness is permanently excluded from federal taxable income under the tax code provision covering loan cancellation tied to qualifying employment.5Office of the Law Revision Counsel. 26 U.S. Code 108 – Income From Discharge of Indebtedness There is no expiration.

IDR forgiveness is now taxable at the federal level. The American Rescue Plan’s temporary exclusion expired December 31, 2025 and was not renewed. If your balance is forgiven in 2026 or later, the IRS treats the canceled amount as income for that year. Most states with an income tax follow the federal exclusion or have their own exemption, but a handful may tax the forgiven amount.

For Total and Permanent Disability discharge, tax timing depends on how you qualified. When the discharge is based on SSA documentation or a medical provider’s certification, you’re treated as receiving the discharge for federal tax purposes at the end of the three-year monitoring period, not when it’s initially approved.8Federal Student Aid. Private Student Loans Have Only One Way Out

PSLF, IDR forgiveness, TPD discharge, borrower defense, and closed school discharge all apply to federal loans only. Federal regulations tie eligibility to specific federal loan types such as Direct, FFEL, and Perkins Loans.1eCFR. 34 CFR 685.219 – Public Service Loan Forgiveness Program Private loans issued by banks, credit unions, and other private lenders are not eligible for any of them.

Bankruptcy is the exception. The undue hardship standard covers both federal loans and private “qualified education loans,” and the same Brunner or totality analysis applies.12Office of the Law Revision Counsel. 11 U.S. Code 523 – Exceptions to Discharge If you carry both federal and private student debt and are considering bankruptcy, an adversary proceeding can address all of it in a single case.
