You can get out of a OneMain Financial loan by refinancing it with a lower-rate lender, negotiating a settlement for less than you owe, enrolling in a debt management plan, or discharging the balance in bankruptcy. OneMain does not charge a prepayment penalty, so leaving early costs nothing beyond the payoff itself.1OneMain Financial. What Is a 10-Day Payoff, and How Does It Work Which route fits depends on your credit, whether the loan is secured by a vehicle or other collateral, and how much financial hardship you’re facing. OneMain’s fixed APRs run between 18% and 35.99%, so even a partial escape from that rate is usually worth pursuing quickly.2OneMain Financial. Personal Loans – Apply Online
Refinance With a Lower-Rate Lender
If your credit has improved since you signed with OneMain, or you can qualify at a bank or credit union with more competitive pricing, refinancing is usually the cleanest exit. A new lender pays off the OneMain balance and you make payments on the new loan going forward, typically at a lower APR and often on a schedule you choose.
Start by requesting a payoff statement from OneMain. This is the exact amount required to close the account on a specific date, including interest accrued since your last payment. OneMain calls this a 10-day payoff figure, and you can request one through customer service or your online account.1OneMain Financial. What Is a 10-Day Payoff, and How Does It Work
The new lender will usually want recent tax returns, bank statements, and proof of income. Many refinance lenders send the payoff funds directly to OneMain rather than depositing them into your account, which closes the old loan cleanly and removes the temptation to spend the money elsewhere.
Settle the Debt for Less Than You Owe
If you’re already behind and can’t realistically pay the full balance, OneMain may accept a lump-sum settlement for less than what you owe. Lenders take these deals when the alternative is a write-off or expensive collection. Successful settlements often land somewhere between 50% and 70% of the outstanding balance, though the exact figure depends on how delinquent you are, your finances, and OneMain’s own policies.
Before you call, gather documentation of the hardship: medical bills, a layoff notice, bank statements showing an income drop. OneMain directs borrowers experiencing payment difficulty to reach out by phone or through a local branch to discuss options.3OneMain Financial. Having Difficulties Making Payments Make a specific offer and explain why that number represents the most the lender can expect to recover.
Don’t send money until you have a written settlement agreement in hand. That document should state the amount you’ll pay, confirm the payment satisfies the debt in full, and describe how OneMain will report the account to the credit bureaus. Payment usually goes by wire or certified check within a few days of signing.
What Settling Does to Your Credit
A settled account is reported as “settled for less than the full balance,” which is a negative mark. Under federal reporting rules that notation can remain on your credit report for up to seven years from the date of the first missed payment that led to the settlement. On-time payments on other accounts help the score recover over time.
The Tax Bill You May Not See Coming
When a lender forgives $600 or more of debt, the forgiven amount is generally treated as taxable income. OneMain (or whoever holds the debt at the time) is required to send you IRS Form 1099-C for the canceled amount, and the IRS expects you to report it.4Internal Revenue Service. About Form 1099-C, Cancellation of Debt Settle a $12,000 balance for $7,000 and the $5,000 difference may count as income on next year’s return.
Two exclusions can reduce or eliminate that liability. If your total liabilities exceeded the fair market value of all your assets right before the cancellation, the insolvency exclusion lets you exclude the forgiven debt from income, but only up to the amount by which you were insolvent. You claim it by filing IRS Form 982. Debt canceled inside a Title 11 bankruptcy case is automatically excluded from taxable income, and the insolvency exclusion doesn’t stack on top of that.5Internal Revenue Service. Publication 4681 – Canceled Debts, Foreclosures, Repossessions, and Abandonments
Set aside money for the potential tax bill before you settle, or talk to a tax professional. Many borrowers who settle while in genuine distress qualify for the insolvency exclusion, but you have to document the asset-to-liability picture to claim it.
Enroll in a Debt Management Plan
A debt management plan through a nonprofit credit counseling agency sits between refinancing and settlement. The agency negotiates with OneMain and your other creditors to reduce interest rates and waive certain fees, and you send one monthly payment to the agency, which pays each creditor.
The full principal gets repaid, so there’s no 1099-C and no “settled” flag on your credit report. Plans generally run three to five years, and you may have to close other credit accounts while enrolled. Agencies affiliated with the National Foundation for Credit Counseling offer free or low-cost initial consultations.
If Your OneMain Loan Is Secured, Act Before Repossession
OneMain writes both unsecured and secured personal loans. Secured loans are backed by a lien on collateral, typically a car, truck, or motorcycle, though boats, RVs, and trailers are also accepted.6OneMain Financial. Our Lending Process Falling behind on a secured loan puts that property at risk.
In most states, a lender can repossess the collateral as soon as you default, often without advance notice, as long as the repossession doesn’t involve threats, force, or breaking into a locked space. If the eventual sale doesn’t cover the balance, most states allow the lender to sue you for the deficiency.7Consumer Advice – FTC. Vehicle Repossession Some states let you reinstate the loan by catching up on missed payments plus repossession costs, rather than paying the full balance at once.8Consumer Financial Protection Bureau. What Happens if My Car Is Repossessed
The practical takeaway: on a secured loan, moving before repossession gives you far more leverage in every other option on this list. After the vehicle is gone, refinancing usually isn’t available and your settlement position weakens.
Discharge the Loan in Bankruptcy
Bankruptcy is the most powerful option and carries the heaviest long-term consequences. An unsecured OneMain loan can be wiped out entirely through a discharge. A secured loan can also be addressed, though you may need to surrender the collateral or keep paying to hold onto it.
Chapter 7 vs. Chapter 13
Chapter 7 liquidates certain non-exempt assets to pay creditors and then discharges most remaining unsecured debt, including personal loans. Cases typically run three to four months from filing to discharge. Qualification depends on income falling below your state’s median or passing a means test that looks at disposable income over five years.9United States Department of Justice. Means Testing
Chapter 13 does not liquidate assets. Instead, you follow a court-supervised repayment plan lasting three to five years based on your disposable income, and qualifying unsecured debt remaining at the end is discharged. Chapter 13 has debt-size limits, though most personal loan borrowers are well under them.
How Filing Works
Federal law requires a credit counseling course from an approved provider within 180 days before filing.10U.S. Courts. Credit Counseling and Debtor Education Courses You then file a voluntary petition with your local bankruptcy court along with schedules of assets, liabilities, income, and expenses. Court filing fees are $338 for Chapter 7 and $313 for Chapter 13, with fee waivers or installment plans available.
The moment you file, the automatic stay under 11 U.S.C. ยง 362 stops most collection activity, including phone calls, lawsuits, and wage garnishments.11Office of the Law Revision Counsel. 11 U.S. Code 362 – Automatic Stay Within 20 to 60 days after filing, a court-appointed trustee runs a meeting of creditors where you answer questions under oath. Creditors may attend but rarely do for consumer cases. A second course, debtor education, is required before the court will issue the discharge.10U.S. Courts. Credit Counseling and Debtor Education Courses Once the discharge order is entered, OneMain can no longer pursue you personally for the balance.
Federal or state exemptions determine what property you keep in a Chapter 7. State exemption schedules are sometimes more generous than the federal set, and an attorney can identify which system protects the most in your situation.12Federal Register. Two Special Situations That Change the Playbook
A Three-Day Right to Cancel a Home-Secured Loan
The federal right of rescission under the Truth in Lending Act applies only to loans secured by your principal residence. It does not apply to unsecured personal loans or to loans secured by a vehicle, and first mortgage purchase loans are also excluded.13Office of the Law Revision Counsel. 15 USC 1635 – Right of Rescission as to Certain Transactions If your OneMain loan placed a lien on your home, you have until midnight of the third business day after signing to cancel.
To use it, send written notice to the lender stating your intent to cancel. Include the account number and the date you signed, and mail it certified with return receipt. Once the lender receives the notice, the agreement is voided, any security interest in your home is released, and the lender must return fees you paid, while you return the loan proceeds.13Office of the Law Revision Counsel. 15 USC 1635 – Right of Rescission as to Certain Transactions The window closes quickly, so this only helps in the days immediately after closing.
Military Lending Act Protections
Active-duty servicemembers and their dependents get additional protections. The Military Lending Act caps the Military Annual Percentage Rate on most consumer loans at 36%, and that calculation includes interest, finance charges, credit insurance premiums, and fees such as application or participation costs. Lenders also can’t require mandatory arbitration, charge a prepayment penalty, or require a military allotment as a condition of the loan.14Consumer Financial Protection Bureau. What Are My Rights Under the Military Lending Act
Violations are serious. A loan agreement that breaks these rules can be declared void from the start, and knowing violations expose the lender to civil liability and criminal penalties.15Office of the Comptroller of the Currency. Military Lending Act, Comptrollers Handbook If you believe your OneMain loan crossed those lines, contact a military legal assistance office or file a complaint with the Consumer Financial Protection Bureau.
