How to Get a Mortgage Payoff Overpayment Refund: Deadlines and Steps

When you pay off a mortgage, you usually overpay by a little, and federal law gives your servicer a fixed window to send the difference back. Most of it lands automatically. When it doesn’t, the fix is straightforward if you know the deadlines.

What’s Actually in the Refund

The biggest piece is almost always escrow. Every month, part of your payment fed an escrow account that covered property taxes and homeowner’s insurance, and your servicer held a cushion on top of what those bills required. Once the loan is closed out, there’s no reason to keep any of it. The size of your refund depends on timing: paying off right after a large tax disbursement leaves the account nearly empty, while paying off a few months before the next tax bill can leave several thousand dollars sitting there.

The second piece is prepaid interest. Payoff quotes are built with a buffer of daily interest, calculated by dividing your annual rate by 365 and multiplying by the number of days in the quote’s validity window, usually 15 or 30 days. If your funds post before the last day of that window, you’ve paid interest for days the loan wasn’t actually open. That difference comes back. Servicers pad these quotes on purpose so they don’t come up short, so the overage is expected rather than an error.

If you paid private mortgage insurance, unearned premiums are refundable too. One boundary worth flagging: FHA upfront mortgage insurance works differently. There’s no cash refund. If you’re refinancing into another FHA loan within three years of your original closing, a partial refund of the upfront premium may be credited toward the new loan’s upfront premium, shrinking each month you held the old loan. The 20-Business-Day Deadline

Under Regulation X, your servicer must return the remaining escrow balance within 20 business days of the payoff.1Consumer Financial Protection Bureau. 12 CFR 1024.34 – Timely Escrow Payments and Treatment of Escrow Account Balances That excludes weekends and federal holidays, so plan on roughly four calendar weeks. This is a federal rule, not a courtesy.

Before cutting the check, the servicer runs a final accounting. It confirms the exact date your funds posted, recalculates per diem interest through that date, verifies that any pending tax or insurance disbursements have cleared, and totals the remaining credits. The difference between what you sent and what you actually owed is your refund. All of that has to happen inside the 20-business-day window for the escrow portion.

Making Sure the Check Reaches You

Update your mailing address with the servicer on the day you close. An outdated address is the single most common reason refund checks go missing, especially when you’ve just sold the property and moved out. Most servicers still send refunds as paper checks; direct deposit exists but is uncommon.

If a title company or closing attorney handled the payoff wire, ask before closing where the refund will land. Some servicers default to sending the refund back to whichever account the payoff funds came from, which means your check goes to the closing agent’s trust account, not your mailbox. Knowing that in advance saves a round of phone calls later.

The check will name every borrower on the original mortgage note, and every named borrower has to endorse it before your bank will deposit it. If a co-borrower is unavailable or the two of you no longer share an account, call your bank about its endorsement rules for multi-payee checks before you try to deposit it.

If nothing arrives four to five weeks after payoff, call customer service and ask for the issue date, the amount, and the address the check went to. If it was lost or misdirected, the servicer will place a stop payment and reissue. A replacement typically takes another 10 to 15 business days.

When the Servicer Misses the Deadline

A phone call clears up most delays. When it doesn’t, two escalation steps tend to work.

Send a Qualified Written Request

A qualified written request is a formal letter that triggers legal deadlines. Include your name, the loan number, and a clear statement that you’re requesting return of the escrow surplus and any other overpayment. Send it to the servicer’s designated address for borrower correspondence, which is usually different from the payment address and listed on your monthly statement or the servicer’s website. Certified mail gives you proof of receipt.

File a CFPB Complaint

If the written request doesn’t produce your money, file a complaint at consumerfinance.gov/complaint. Select “Mortgage” as the product, name the servicer, and describe the overdue refund with dates and amounts. The CFPB forwards complaints directly to the company. Servicers generally respond within 15 days, and can take up to 60 days for complex issues.7Consumer Financial Protection Bureau. Submit a Complaint Complaints filed through a federal regulator tend to reach a servicer’s file in a way that repeat phone calls don’t.

If You Refinanced Instead of Selling

Refinancing changes one thing. With your consent, the servicer can transfer your old escrow balance directly into the escrow account for your new loan rather than sending a check, a shortcut called escrow netting.1Consumer Financial Protection Bureau. 12 CFR 1024.34 – Timely Escrow Payments and Treatment of Escrow Account Balances It only works cleanly when the same company services both loans, and it requires your authorization. If nobody discussed it with you, you’re still entitled to the refund check. When the new loan is with a different lender, expect a refund check from the old servicer and to fund the new escrow separately.

Taxes on the Refund

Escrow money coming back is not taxable. It was already your money, held in trust to pay taxes and insurance.

Refunded interest is different. If the refund arrives in the same tax year you paid the interest, reduce your mortgage interest deduction by the refunded amount; the Form 1098 for that year will show it in Box 4.8Internal Revenue Service. For most payoffs, the interest piece is a few days of per diem and the tax effect is negligible. If your final 1098 shows a larger adjustment, compare it against what you claimed. Separately, if the servicer paid you $10 or more in interest on the escrow balance, expect a Form 1099-INT and treat that as ordinary income.11Internal Revenue Service. If the Refund Was Sent Years Ago and Never Cashed

An uncashed refund check eventually gets turned over to the state as unclaimed property, a process called escheatment. Dormancy periods are set by each state and commonly run one to five years. The money doesn’t vanish; it sits with the state’s unclaimed property office until you claim it.

Search MissingMoney.com, a free tool endorsed by the National Association of Unclaimed Property Administrators, or go directly to your state treasurer’s or comptroller’s website. You’ll need your name and often a former address. To file the claim, keep your payoff confirmation letter and the original loan number handy; documentation linking you to the mortgage speeds things up. Processing usually takes a few weeks to a few months.
