You can file Chapter 7 bankruptcy yourself, and free online tools can prepare every form for you, but “online” is only partly accurate: most pro se filers still print the completed packet and deliver it to their local bankruptcy court clerk. Here is how to file Chapter 7 bankruptcy online yourself, from checking your eligibility to receiving a discharge, which typically arrives four to six months after you file. The filing fee is $338, and the process has two mandatory courses, one meeting with a trustee, and a long list of forms that must be accurate down to the dollar.
Confirm You Qualify Before You Start
Chapter 7 has a financial eligibility test called the means test. It compares your average monthly income over the six months before filing to the median income for your household size in your state.1United States Department of Justice. Means Testing Below the median, you pass. Above it, a second calculation looks at your allowable monthly expenses to decide whether you have enough left over to fund a Chapter 13 repayment plan. If you do, the court can presume that filing Chapter 7 is an abuse and steer you toward Chapter 13 instead.
Two timing rules can also block you. Step 1: Take the Pre-Filing Credit Counseling Course
Federal law requires you to complete a briefing from a nonprofit credit counseling agency approved by the U.S. Trustee Program before you file.4Office of the Law Revision Counsel. 11 US Code 109 – Who May Be a Debtor The session runs about an hour and can be done online, by phone, or in person. It has to happen within the 180 days before your filing date, and you receive a certificate of completion that goes into your petition packet.
Only agencies on the U.S. Trustee Program’s approved list count. Using any other provider means the court will reject your certificate. The Program keeps a searchable directory on its website. Fees are usually modest, and if your household income is under 150 percent of the federal poverty line you are presumptively entitled to a reduced rate or full waiver. Narrow exceptions exist. Step 2: Pull Together Your Financial Records
Chapter 7 forms demand a full accounting of your finances. Incomplete or inaccurate information is one of the fastest ways to get a case delayed, dismissed, or flagged for fraud. Before you open the forms, gather:
- Pay stubs for the six months before filing, tax returns for at least the last two years, and records of any other income such as freelance work, rental income, or government benefits.
- Statements for every debt: credit cards, medical bills, personal loans, car loans, mortgages, student loans, court judgments, and tax debts.
- Bank statements, vehicle titles, property deeds, retirement account statements, and a rough inventory of personal property such as electronics, furniture, and jewelry.
- Recent utility bills, insurance statements, childcare costs, and other regular monthly obligations.
Disclose everything. Hiding an asset or understating income can lead to a denied discharge and, in serious cases, criminal prosecution. If you are unsure whether something counts, list it. The trustee will review all of it either way.

- Form 107, the Statement of Financial Affairs, a history of your recent financial transactions including payments to creditors, lawsuits, and property transfers.

- Form 108, the Statement of Intention, declaring what you plan to do with secured debts: surrender, reaffirm, or redeem.

This is the closest most filers get to filing entirely “online.”
Whether you can also submit the packet electronically depends on your court. Some bankruptcy courts allow pro se filers to use the CM/ECF (Case Management/Electronic Case Files) system, but many restrict electronic filing to attorneys. Call your local bankruptcy court clerk’s office before you assume you can e-file. If e-filing is not available, you will print the packet and take it to the clerk in person or mail it, depending on what the court accepts.

Know What Property You Get to Keep
When you file, your assets technically become part of a bankruptcy estate, and the court-appointed trustee’s job is to sell non-exempt property and distribute the proceeds to creditors. Exemptions shield specific property from that process. Federal law provides a set of exemptions, and each state can opt out and require its residents to use state exemptions only.10Office of the Law Revision Counsel. 11 USC 522 Roughly two-thirds of states have opted out. In states that have not, you pick the set that protects more of your property, but you cannot mix and match.
For cases filed between April 2025 and March 2028, the federal exemptions include up to $31,575 in home equity, up to $5,025 in equity in one vehicle, and a wildcard of $1,675 plus up to $15,800 of any unused portion of the homestead exemption applied to any property you choose. Married couples filing jointly can double these amounts. In practice, most Chapter 7 cases are “no-asset” cases: everything the debtor owns is either exempt or not worth the trustee’s effort to sell.
Step 4: What Happens After You File
The moment your petition hits the docket, an automatic stay takes effect. The 341 Meeting of Creditors
Between 20 and 40 days after you file, the trustee holds a meeting of creditors, known as the 341 meeting.12United States Department of Justice. Section 341 Meeting of Creditors Creditors rarely show up. There is no judge and no courtroom, and it typically runs 10 to 15 minutes. Many courts now hold the meeting by phone or video. The trustee verifies your identity with a government-issued photo ID and proof of your Social Security number, then asks questions under oath about your assets, debts, income, and recent transactions. The Debtor Education Course
Before your discharge can be granted, you have to complete a second course, the personal financial management or debtor education course. It is separate from the pre-filing credit counseling and cannot be taken at the same time.5U.S. Trustee Program. Discharge
If no non-exempt assets need to be sold and no one objects, the court grants a discharge roughly 60 days after the first date set for the 341 meeting, or about four months after you filed.15United States Courts. Discharge in Bankruptcy – Bankruptcy Basics The order permanently eliminates your personal liability on the discharged debts, and creditors can never legally try to collect them from you again.
Debts Chapter 7 Will Not Wipe Out
Chapter 7 does not erase everything. Several categories of debt survive a discharge:16Office of the Law Revision Counsel. 11 USC 523
- Child support and alimony, under any circumstances.
- Government-backed and qualified private student loans, unless you prove undue hardship, which is a notoriously difficult standard to meet.
- Recent income taxes: generally, taxes survive if the return was due within three years of filing, was filed late within two years of filing, or was assessed within 240 days of filing. Taxes involving fraud or willful evasion are never dischargeable.
- Debts from fraud, false pretenses, or misrepresentation. Luxury purchases over $900 made within 90 days of filing and cash advances over $1,250 taken within 70 days of filing are presumed non-dischargeable.
- Court judgments for death or personal injury caused by driving while intoxicated.
- Criminal fines and restitution.
If your main reason for filing is one of these debts, Chapter 7 will not solve the problem. Worth knowing before you pay the fee and take the credit hit.
How Filing Affects Your Credit
A Chapter 7 filing stays on your credit report for up to 10 years from the date you filed.17Office of the Law Revision Counsel. 15 USC 1681c Lenders, landlords, employers, and insurers can see it during that period. The impact is heaviest in the first two to three years, when new credit is harder to get and carries higher rates.
Most people who reach the point of filing already have severely damaged credit from missed payments, collections, and judgments. Discharge removes the underlying debts dragging the score down, and many filers see their scores start to recover within a year or two. Rebuilding usually begins with a secured credit card and consistent on-time payments.
