Debit Card and Checking Account Claims

Unauthorized debit card transactions and other electronic fund transfer errors are governed by the Electronic Fund Transfer Act and Regulation E. The rules turn on how fast you report, so speed is the whole game.

Your Liability Depends on When You Report

Tell Wells Fargo within two business days of learning about an unauthorized transaction and your maximum liability is $50. Miss that window but report before 60 days from when the bank sent your statement, and your exposure rises to $500. The 60-day cliff is the one that catches people. If someone drains your account through a series of small transfers and you don’t look at statements for months, the bank has no obligation to make you whole for losses after that mark. Review your statements when they arrive.

Investigation Timelines and Provisional Credit

Once you report the error, Wells Fargo has 10 business days to investigate and tell you the result. The bank can extend the investigation to 45 days, but only if it provisionally credits your account within those first 10 business days. It can hold back up to $50 from the provisional credit if it reasonably believes an unauthorized transfer occurred. If the bank concludes no error occurred, it can reverse the provisional credit, but it must notify you at least three business days beforehand and explain its findings in writing. You can then request copies of the documents the bank relied on.

Credit Card Billing Disputes

Credit card claims run under a different law. The Fair Credit Billing Act covers billing errors on credit cards, and it has one requirement that debit disputes don’t: written notice within a fixed window.

You have 60 days from the date the statement containing the error was sent to submit a written dispute to the address the card issuer designates for billing inquiries. The notice must identify your account, describe the error and amount, and explain why you believe it’s wrong. Once Wells Fargo receives the written notice, it must acknowledge the dispute within 30 days. It then has two complete billing cycles, no more than 90 days total, to either correct the error or send you a written explanation of why the charge is accurate. During the investigation, the bank cannot try to collect the disputed amount or report it as delinquent to credit bureaus.

Billing errors covered by this law include charges for goods you didn’t receive or didn’t accept, charges in the wrong amount, and unauthorized transactions. If the dispute involves merchandise not delivered as agreed, the bank cannot close the investigation in the merchant’s favor without confirming the goods were actually sent.

Overdraft Fee Claims

Overdraft fees are one of the more common bank complaints. If you think a fee was improperly charged, check whether you opted in to overdraft coverage for one-time debit card and ATM transactions. Mortgage disputes are more complex because dollar amounts are larger and multiple federal laws apply. If you believe Wells Fargo misapplied a mortgage payment, failed to pay property taxes from your escrow account, or made another servicing error, RESPA’s Regulation X gives you a formal tool called a notice of error.

Send a written letter to the address Wells Fargo designates for error resolution (PO Box 10335, Des Moines, IA 50306-0335) identifying the error with enough detail for the servicer to investigate. After receiving it, Wells Fargo must acknowledge the notice in writing within five business days. For most errors, the bank then has 30 business days to either correct the problem or explain in writing why it believes no error occurred. Filing a CFPB Complaint

The Consumer Financial Protection Bureau takes complaints about banking products, credit cards, mortgages, and other financial services at consumerfinance.gov/complaint. Because Wells Fargo is a national bank, the Office of the Comptroller of the Currency also supervises it. File a complaint through helpwithmybank.gov. Maximum claim amounts vary by state, typically from $2,500 to $25,000, with most states at $5,000 or $10,000. Filing fees are low, and the process is designed for people representing themselves.

The Arbitration Clause Limits Your Court Options

Wells Fargo’s account agreements generally require disputes to be resolved through binding arbitration rather than court. Whether that clause blocks a small claims filing depends on your jurisdiction and the specific language in the agreement. Under consumer arbitration rules, the bank typically covers most of the administrative costs, and consumer filing fees are generally a few hundred dollars. Check your account agreement for the arbitration organization named to see which fee schedule applies. Courts have occasionally struck down arbitration clauses as unconscionable, but the bar is high; if you believe your clause is unenforceable, talk to an attorney before assuming you can bypass it.

Documentation That Makes a Claim Stick

The strength of your file often decides the outcome. Banks process thousands of disputes, and the ones resolved favorably tend to have organized evidence.

Pull your account statements showing the disputed transactions or fees. Save receipts, confirmation numbers, and any correspondence that contradicts what appeared on your statement. For mortgage claims, the documentation bar is higher: payment records, any loan modification paperwork, escrow statements, and copies of previous correspondence with the servicer. If Wells Fargo communicated a decision verbally, follow up right away with a letter summarizing what was said and asking for written confirmation. One common mistake sinks otherwise valid claims: waiting too long.
