How Soon Can You Refinance a VA Loan: The 210-Day Rule and Recoupment

You can refinance a VA loan into another VA loan once two things are true: at least 210 days have passed since your first monthly payment, and you’ve made at least six monthly payments. Whichever milestone lands later is the earliest your new loan can close. If you’re refinancing a conventional, FHA, or USDA loan into a VA cash-out loan, that waiting period doesn’t apply and you can move much sooner.

The 210-Day Rule Explained

Federal regulation sets a mandatory seasoning period before the VA will guarantee a refinance that replaces an existing VA-guaranteed mortgage. It applies to both refinance products the VA offers: the Interest Rate Reduction Refinance Loan (IRRRL, sometimes called a streamline) and the cash-out refinance when the loan being paid off is itself a VA loan.

Two conditions must both be satisfied:

You cannot close until whichever date arrives later. If you happen to make your sixth payment on day 180, you still wait until day 211. If your sixth payment doesn’t land until day 220, that later date controls.

The regulation says “the date on which the sixth monthly payment is made,” so the payments have to actually be made, not merely be due.1eCFR. 38 CFR 36.4306 – Refinancing of Mortgage or Other Lien Indebtedness The rule exists to prevent loan churning, the practice of pushing veterans into repeated refinances that generate fees without producing meaningful savings.

When the Waiting Period Doesn’t Apply

If your current mortgage is anything other than a VA-guaranteed loan and you want to refinance it into a VA cash-out loan, the 210-day and six-payment requirements are off the table. The regulation itself limits the waiting period to cases where “the loan being refinanced is a VA-guaranteed or insured loan,” and the VA’s cash-out refinance user guide confirms that seasoning certification is required only for VA-to-VA refinances.2Veterans Benefits Administration. You still have to meet every other VA requirement: full credit review, appraisal, and evidence that the refinance produces a net tangible benefit. But the age of your existing loan won’t block you.

What Else Has to Be True Before You Close

Meeting the calendar is one part. The VA also requires that the refinance actually help you financially, and the tests differ by loan type.

Recoupment Within 36 Months

For an IRRRL, all fees, closing costs, and expenses rolled into the new loan have to be recoverable through monthly payment savings within 36 months. The lender divides total costs by the monthly payment reduction. If the break-even runs longer than three years, the refinance doesn’t qualify.

Minimum Rate Reduction

Refinancing from one fixed-rate loan to another fixed-rate IRRRL requires a new rate at least 50 basis points (0.50%) below the old rate. Moving from a fixed rate to an adjustable rate requires a reduction of at least 200 basis points (2.00%).3Federal Register. ARM to Fixed Is Different

The rate-reduction rule is waived when you move from an adjustable-rate mortgage to a fixed-rate loan. Your new rate may even be higher than your current one. The rationale is that locking in a predictable payment carries its own long-term value.4Veterans Benefits Administration. Refinancing Loans The lender still has to demonstrate that the switch serves your financial interests over the life of the loan.

Costs That Come With Refinancing

Most VA refinance borrowers pay a one-time funding fee that supports the loan program. The amount depends on the refinance type and whether you’ve used the VA benefit before:

  • IRRRL: 0.5% of the loan amount, regardless of prior use.
  • Cash-out refinance, first use: 2.15% of the loan amount.
  • Cash-out refinance, after first use: 3.3% of the loan amount.

The funding fee can be rolled into the loan balance instead of paid upfront. You’re exempt from the fee if you receive VA disability compensation, if you’re a surviving spouse receiving Dependency and Indemnity Compensation, or if you’re an active-duty service member with a Purple Heart.5Veterans Affairs. Federal regulation caps the flat origination fee on any VA loan, including both refinance types, at 1% of the loan amount. That cap replaces the separate processing, underwriting, and document preparation charges conventional lenders sometimes itemize.6eCFR. 38 CFR 36.4313 – Charges and Fees Fees outside the cap, such as the appraisal, credit report, title insurance, and recording charges, are still permitted, so your total closing costs will run higher than 1%.

Occupancy: Cash-Out vs. IRRRL

The two products treat occupancy differently. A cash-out refinance requires you to currently occupy the home as your primary residence, so it isn’t available for a rental or a home you’ve moved away from.7Veterans Benefits Administration. VA Loan Purposes, Types, and Refinance Comparison

An IRRRL only requires you to certify that you previously occupied the home as your primary residence.8United States Department of Veterans Affairs. Refinancing Options Veterans who have since relocated, whether because of a PCS move or personal reasons, can still use an IRRRL to lower the rate on a home they no longer live in.

Documents You’ll Need

Certificate of Eligibility

Any VA refinance starts with a Certificate of Eligibility (COE) that confirms your remaining loan entitlement. You can download it through the VA’s eBenefits portal, or your lender can pull it electronically.9Veterans Affairs. Credit and Income

The VA doesn’t set a minimum credit score, but most lenders impose their own floor, typically around 620.10Veterans Benefits Administration. A cash-out refinance typically calls for two years of W-2s, 30 days of pay stubs, recent bank statements, and your current mortgage statement.

Second Mortgage Subordination

If you have a second mortgage or a home equity line of credit, that lienholder has to agree to subordinate so the new VA loan sits in first position. A cash-out refinance must close as a first lien.8United States Department of Veterans Affairs. Refinancing Options Subordination agreements can take time, so open that conversation early.

After You Sign: The Three-Day Rescission Window

Federal law gives you a short cancellation window after you close a refinance on your primary residence. Under the Truth in Lending Act, you can cancel until midnight of the third business day following closing, delivery of the required rescission notice, or delivery of all material disclosures, whichever comes last.11Consumer Financial Protection Bureau. 1026.23 Right of Rescission If you’re refinancing with the same lender who holds your current loan, the rescission right applies only to any new money borrowed beyond the existing balance, so it covers the cash-out portion but not the balance being replaced. No funds are disbursed until the rescission period expires, so add a few days to your timeline before any cash-out proceeds arrive.
