How Can I Assume a Mortgage: Approval, Equity, and Closing

To assume a mortgage, you take over the seller’s existing home loan — keeping its interest rate, balance, and repayment schedule — after the lender reviews your credit and income and approves the transfer. Only FHA, VA, and USDA loans are routinely assumable; most conventional loans are not. Here is how the process works from confirming the loan type through closing.

Confirm the Loan Is Assumable

Before anything else, find out what kind of loan the seller has. Most conventional mortgages contain a due-on-sale clause that lets the lender demand full repayment when the property changes hands, and federal law at 12 U.S.C. § 1701j-3 backs the lender’s right to enforce it.1Office of the Law Revision Counsel. 12 USC 1701j-3 – Preemption of Due-on-Sale Prohibitions In a normal arm’s-length sale, that means a conventional loan is almost never assumable by a third-party buyer.

The three government-backed programs are different:

  • All FHA-insured single-family forward mortgages are assumable. For loans closed on or after December 15, 1989, the lender must run a full credit review before approving you.   • VA loans are assumable, and you do not have to be a veteran to assume one. You still have to qualify from a credit standpoint as if you were applying for a new VA-guaranteed loan in the amount of the unpaid balance. If you are not a veteran, the seller’s VA entitlement stays tied up in the property until the loan is paid off; if you are a veteran willing to substitute your own entitlement, the seller’s is restored.5Office of the Law Revision Counsel. 38 USC 3714 – Assumptions; Release From Liability6Veterans Affairs.   • USDA Section 502 guaranteed loans can be assumed, but you must meet the program’s original eligibility rules, including income limits and the requirement that the home sit in an eligible rural area. Your lender must send a written request to USDA Rural Development and obtain agency approval before consenting to the transfer.7eCFR. 7 CFR 3555.256 – Transfer and Assumptions

Ask the seller for a recent mortgage statement. It identifies the servicer and the loan type, which is where every next step begins.

Plan How You’ll Cover the Seller’s Equity

Assuming a mortgage means taking over the remaining balance, not paying the current value of the home. If the house is worth $350,000 and the loan balance is $200,000, you owe the seller $150,000 for their equity at closing. On a home the seller has owned for many years, that gap is often the hardest part of the deal.

Buyers typically bridge it one of three ways:

  • Paying the equity in cash at closing.
  • Taking out a second mortgage, then carrying two monthly payments — the assumed first loan and the new second, which usually has a higher rate.
  • Accepting seller financing, where the seller carries a note for part of the equity and you repay them over time.

If you use secondary financing on an FHA assumption, the second loan must have clearly defined repayment terms, and the lender will count that payment alongside the assumed mortgage payment when deciding whether you can afford the total obligation.3HUD. What the Lender Will Want to See

The underwriting review for an assumption looks a lot like the review for a new mortgage. Gather:

  • Recent pay stubs and current proof of income
  • W-2s or tax returns for the previous two years
  • Bank statements showing liquid funds for closing costs and any equity payment
  • A full list of your monthly debts
  • Written authorization to pull your credit

Credit expectations vary by program. FHA loans can be assumed with scores as low as 580. VA lenders and most conventional overlays look for at least 620.8Veterans Affairs. VA Home Loan Guaranty Buyers Guide Debt-to-income limits also differ: FHA generally wants your total DTI at 43% or below, with room for higher ratios when compensating factors exist; VA runs a residual income analysis instead of a hard ratio; USDA typically targets 41% or lower.

If the assumption is tied to a divorce or legal separation, include a certified copy of the decree or settlement with your file. Employment verification forms are common, and a short written explanation of any recent credit inquiries or unusual deposits can save the underwriter a follow-up.

Submit the Assumption Request to the Servicer

Contact the loan servicer — the company the current owner sends payments to — and ask for an assumption application package. You will need the property address and the existing loan number, both on the seller’s monthly statement.

Most servicers accept applications by certified mail with return receipt; some now have secure online portals. Expect to pay a processing fee when you submit. FHA lenders can charge up to $1,800 for an assumption.9HUD. For FHA assumptions, the lender must complete its creditworthiness review within 45 days of receiving all required documents.11HUD. Chapter 4 – Credit Underwriting VA and USDA files can run longer, especially when USDA has to sign off. During the review, the underwriter verifies employment, checks for undisclosed liens or judgments, and confirms that property taxes and insurance are current. If they need more information, they will send a request with a deadline; respond quickly.

Closing and Release of Liability

Once the lender approves you, everyone meets at closing to sign the assumption agreement. That document legally binds you to the original promissory note and mortgage. A deed transferring title is signed at the same closing and later recorded with the county recorder’s office.

The other critical piece at closing is the seller’s release of liability. Without it, the original borrower can still be pursued by the lender if you later default, so sellers care about this as much as buyers do.

  • For FHA loans closed after December 15, 1989, the lender must prepare a release of liability once the assuming borrower is found creditworthy and signs the assumption agreement. The release runs on HUD Form 92210.1.3HUD. Chapter 7 – Assumptions

  • For USDA guaranteed loans, the original borrower generally remains personally liable even after the transfer.7eCFR. 7 CFR 3555.256 – Transfer and Assumptions

If Your Assumption Application Is Denied

Under the Equal Credit Opportunity Act, a lender that denies your application must send written notice with either the specific reasons for the denial or a disclosure of your right to request those reasons within 60 days.12eCFR. 12 CFR Part 1002 – Equal Credit Opportunity Act, Regulation B A generic reference to “internal standards” is not enough; the notice has to identify the principal factors, such as insufficient income, excessive debt, or credit history.

For VA loan assumptions, if the lender decides the loan is not current or that you fall short on credit, you can appeal to the Department of Veterans Affairs, which will conduct its own review.5Office of the Law Revision Counsel. 38 USC 3714 – Assumptions; Release From Liability

After Closing: Basis and Interest Deduction

Your tax basis in the home is the cash you paid plus the remaining mortgage balance you assumed. Pay $50,000 in cash and take on a $200,000 loan, and your basis is $250,000.13Internal Revenue Service. Publication 551 – Basis of Assets That figure will matter when you eventually sell.

You can deduct mortgage interest on the assumed loan as long as it is a secured debt on a qualified home you own and occupy, and you itemize.14Internal Revenue Service.
