Do Checks Expire If Not Cashed? Rules by Check Type

Yes, checks can expire if not cashed, but the rule depends on the type. Personal and business checks generally go stale six months after the date written on them, at which point a bank is no longer required to honor them. U.S. Treasury checks and Social Security checks are void one year after issuance. Cashier’s checks, certified checks, postal money orders, and travelers checks work differently, and in most cases the money behind an old check can still be recovered even if the paper itself is no longer good.

Personal and Business Checks: The Six-Month Rule

Under Section 4-404 of the Uniform Commercial Code, a bank is not obligated to pay a check presented more than six months after its date.1Legal Information Institute. Six months does not automatically void the check. It removes the bank’s duty to process it. Some banks will still cash an older check in good faith, especially for long-standing customers; others reject stale-dated items on sight. U.S. Treasury, Social Security, and State Checks

Government checks follow statutes, not the UCC, and the timelines are stricter.

Checks issued by the U.S. Treasury, including federal tax refunds and other federal payments, are valid for exactly one year from the date of issuance. Social Security benefit checks carry the same “VOID AFTER ONE YEAR” designation.4Social Security Administration. State-issued checks have their own timelines that vary by jurisdiction, generally anywhere from six months to one year. If you have an older state check, ask the issuing state agency.

Cashier’s Checks and Certified Checks

The UCC’s six-month rule explicitly excludes certified checks. A bank that certifies a check stays on the hook to pay it even after six months.1Legal Information Institute. Money Orders and Travelers Checks

Private-issuer money orders are different. Western Union money orders that go unused for one to three years, depending on the state of purchase, can be hit with a non-refundable service charge deducted from the face value.8Western Union. Travelers checks do not expire. American Express, the most widely recognized issuer, states that its travelers checks carry no expiration date and remain backed by the company indefinitely.9American Express. Personal or Business Checks

If a personal or business check in your possession is more than six months old, contact the person or company that issued it before doing anything else. Have the check number, date, and dollar amount ready so they can find the transaction in their records and confirm the money was never withdrawn.

The issuer will usually put a stop-payment order on the original to prevent it from being cashed twice, then write you a new one. Stop-payment fees generally run $15 to $35.

Expired Treasury or Social Security Checks

If Years Have Passed: Check for Unclaimed Funds

Uncashed money does not disappear. Every state has unclaimed property laws requiring banks and businesses to turn dormant funds over to the state treasury through a process called escheatment.11Investor.gov (SEC). The dormancy period varies by state, but for checking accounts and uncashed checks it is most commonly three or five years, and sometimes shorter.12Department of Labor. If enough time has passed that the money may have been turned over, search MissingMoney.com, the unclaimed property database endorsed by the National Association of Unclaimed Property Administrators and the National Association of State Treasurers.13MissingMoney.com. If You Wrote the Check: Stop-Payments and Taxes

Writing a check and never seeing it cashed does not mean the money is safe in your account. Because banks retain discretion to honor stale items in good faith, an old check can still hit your account months later.1Legal Information Institute. You can renew a stop-payment for another six months, but only before the current one expires.14Legal Information Institute. Holding a check also does not delay income tax on it. Under the IRS constructive receipt doctrine, income is taxable in the year it becomes available to you, whether or not you actually deposit the check. A paycheck received in December is taxable that year even if you cash it in January.15Internal Revenue Service. One final point that often gets missed: the check going stale does not erase the debt. The obligation exists independently of the piece of paper. If a check you were owed is now too old to cash, the person or company that wrote it still owes you the money, and a replacement is the appropriate remedy.
