If Credit Acceptance is suing you, the lawsuit is almost certainly for a deficiency balance — what they say you still owe after repossessing and reselling your vehicle. You have real defenses, but only if you act by the deadline printed on the summons. Ignoring the case guarantees a default judgment for the full amount they’re claiming, plus the power to garnish wages and levy your bank account. Filing an answer, attacking how the car was sold, checking the statute of limitations, or invoking arbitration can all change the outcome. So can a written settlement.
What Credit Acceptance Is Actually Suing For
Credit Acceptance buys retail installment contracts from car dealers. When you financed the car through one of their dealer partners and then fell behind, they had the right to repossess it and sell it. The lawsuit in front of you now is almost certainly a deficiency claim: the balance left on the loan after the sale, plus repossession costs, late fees, and interest.
The case starts with a summons and complaint delivered to you in person or by certified mail. The summons names the court and states your deadline to respond. The complaint lists the allegations and the dollar amount claimed. In federal court, you have 21 days after service to file a response.1United States Courts. Summons in a Civil Action State deadlines generally run 20 to 30 days. Your exact deadline is printed on the summons — read it first, before anything else.
File an Answer Before the Deadline
Miss the deadline and the court enters a default judgment against you for whatever Credit Acceptance asked for, without examining the merits.2Legal Information Institute. Federal Rules of Civil Procedure Rule 4 That judgment lets them garnish wages, seize funds from your bank account, and record liens against property.
Your answer walks through each allegation in the complaint and either admits it, denies it, or states that you lack information to respond. It’s also where you raise defenses — expired statute of limitations, a commercially unreasonable sale, faulty accounting — and any counterclaims. Filing fees vary by jurisdiction but are usually modest. After filing with the clerk, you serve a copy on Credit Acceptance’s attorney.
If the complaint is fundamentally defective (wrong defendant, wrong court, or no valid legal claim on its face), a motion to dismiss can be filed instead of or alongside the answer. Either way, filing opens the discovery process, which lets you demand records of the sale, an itemized breakdown of every fee, and proof they followed the required procedures. Those records usually determine which defenses work.
Attack How the Vehicle Was Sold
This is where most Credit Acceptance deficiency cases turn. Under the Uniform Commercial Code, every aspect of a repossessed vehicle’s sale — method, timing, marketing, and terms — must be “commercially reasonable.”3Legal Information Institute. Uniform Commercial Code 9-610 – Disposition of Collateral After Default If your car was run through a wholesale dealer auction with minimal advertising and went for a fraction of retail, the sale may not clear that bar.
The burden works in your favor here. If Credit Acceptance can’t prove the sale was commercially reasonable, the law presumes the vehicle would have brought enough to cover the entire debt, which wipes out the deficiency.4Legal Information Institute. Uniform Commercial Code 9-626 – Action in Which Deficiency or Surplus Is in Issue They have to prove the sale was fair. You don’t have to prove it wasn’t.
Courts weigh several things when evaluating a sale:
- Whether the lender sent you written pre-sale notice with enough lead time to redeem the vehicle by paying off the loan.
- How the vehicle was marketed — to actual retail buyers, or only through a dealer-only wholesale channel.
- Whether multiple buyers had a real chance to bid.
- How the sale price compared to fair market value. A price well below book value raises serious questions.
Use discovery to demand every document tied to the sale: auction records, any marketing materials, the sale price, buyer information, and a line-by-line accounting of how Credit Acceptance calculated the deficiency. Errors in the accounting show up often — misapplied payments, double-counted fees, uncredited insurance refunds — and each error reduces what you can be held to owe.
Check the Statute of Limitations
Every state sets a deadline for creditors to sue on a defaulted debt. For auto loans, which are written contracts, the window typically runs three to six years from your last payment or the date of default. If Credit Acceptance filed after that window closed, you have a complete defense — but you have to raise it in your answer. Courts do not apply it on their own.
Be precise about the date of your last payment and the date the lawsuit was filed. The gap between those two dates is the whole question.
Be equally careful about anything that could restart the clock. In many states, making even a small payment on the old debt, or acknowledging the balance in writing, can reset the statute of limitations and give Credit Acceptance a fresh window to sue. If a collector calls about an old debt, don’t promise to pay and don’t confirm the balance until you’ve checked whether the limitations period has already run.
Invoke the Arbitration Clause if Your Contract Has One
Credit Acceptance retail installment contracts typically include an arbitration clause.5Credit Acceptance. Terms of Use If yours does, you can file a motion to compel arbitration, which asks the court to pause the lawsuit and send the dispute to a private arbitrator.
Arbitration shifts the dispute to a forum where the lender typically pays most of the costs. Filing fees and arbitrator compensation often run into the thousands, and for a relatively small deficiency Credit Acceptance may decide the case isn’t worth pursuing. Moving to arbitration doesn’t cost you any defenses. You can still challenge the sale, the accounting, and the statute of limitations there.
Timing matters. Pull your original loan agreement, find the arbitration provision, and file the motion to compel early — with your answer, or shortly after. Wait too long, or participate too actively in the litigation, and a court can treat that as waiving arbitration.
Negotiate a Settlement
Nothing forces this case to trial. Credit Acceptance, like most lenders, would rather collect something now than litigate for months toward an uncertain result. Settlements can happen at any stage, and the stronger your defenses look on paper, the more room there is to deal.
A typical settlement is either a lump sum well below the claimed deficiency or a structured payment plan at a reduced total. Get the agreement in writing, and make sure it explicitly resolves the lawsuit and releases you from any further liability on the debt. Without that release language, you can pay and still face collection for the rest.
One thing people miss: if Credit Acceptance forgives more than $600 as part of the settlement, they must report the forgiven amount to the IRS on Form 1099-C.6Internal Revenue Service. Two exceptions can reduce or eliminate the tax hit. Debt discharged in bankruptcy is excluded from income entirely.7Office of the Law Revision Counsel. 26 USC 108 – Income From Discharge of Indebtedness And if you’re insolvent when the debt is forgiven — total debts exceed the fair market value of everything you own — you can exclude the forgiven amount up to the extent of your insolvency.8Internal Revenue Service. What if I Am Insolvent? Many people facing a Credit Acceptance deficiency qualify for the insolvency exclusion without realizing it. IRS Form 982 is what you file with your return to claim either one.
Bankruptcy Stops Everything Immediately
Filing bankruptcy triggers an automatic stay that halts most collection efforts, including active lawsuits, wage garnishments, and bank levies.9United States Bankruptcy Court – Central District of California. Automatic Stay, What Is It and Does It Protect a Debtor From All Creditors? In a Chapter 7 case, the deficiency balance may be discharged entirely. In Chapter 13, it gets rolled into a court-supervised repayment plan based on what you can actually pay.
This is not a light decision. Bankruptcy stays on your credit report for seven to ten years and constrains borrowing for a long time after. But if you have a large deficiency stacked on top of other debts, limited income, and few assets, it may be the fastest way to stop the damage. If Credit Acceptance Wins the Case
A judgment gives Credit Acceptance access to several collection tools. Post-judgment interest starts running immediately. But the judgment doesn’t collect itself. They still have to take specific legal steps to reach your money, and each of those steps has limits.
Wage Garnishment
A court order can direct your employer to withhold part of your paycheck. Federal law caps the take at the lesser of 25% of your disposable earnings, or the amount by which your weekly disposable earnings exceed $217.50 (30 times the current federal minimum wage of $7.25 per hour).10Office of the Law Revision Counsel. 15 USC 1673 – Restriction on Garnishment Whichever number is smaller is the ceiling.11U.S. Department of Labor. Fact Sheet 30 – Wage Garnishment Protections of the Consumer Credit Protection Act If your disposable earnings are at or below $217.50 per week, wages cannot be garnished at all. Many states impose tighter limits.
Bank Levies
A levy lets Credit Acceptance seize funds sitting in your account, not future paychecks. Your bank freezes the funds and turns them over unless you challenge the levy in court.
Some deposits are protected. If you receive federal benefits like Social Security, veterans’ benefits, or federal disability payments by direct deposit, the bank must automatically protect roughly two months’ worth of those deposits from levy.12Consumer Financial Protection Bureau. Social Security benefits are broadly shielded from garnishment by private creditors under federal law.13Social Security Administration. SSR 79-4 – Levy and Garnishment of Benefits The protection is strongest when benefits are directly deposited and haven’t been commingled with other funds.
Property Liens
A judgment can be recorded as a lien against real estate you own. The lien doesn’t force an immediate sale, but it attaches to the title, and it has to be paid off when you sell or refinance. Liens stay in place until the judgment is satisfied or expires under state law. If the equity in your home is below your state’s homestead exemption, the lien exists on paper but cannot be enforced through a forced sale.
Rights When Third-Party Collectors Get Involved
An important distinction: Credit Acceptance typically acquires the loan from the dealer before any default, which generally makes the company itself a creditor rather than a “debt collector” under the Fair Debt Collection Practices Act.14Office of the Law Revision Counsel. 15 USC 1692a – Definitions The FDCPA excludes anyone collecting on a debt that wasn’t in default when they got it.
But if Credit Acceptance hires an outside law firm or collection agency, those third parties are debt collectors under the FDCPA and must follow its rules.15Consumer Financial Protection Bureau. What Laws Limit What Debt Collectors Can Say or Do? No calls before 8 a.m. or after 9 p.m., no threats or misrepresentations, and no direct contact with you once you’re represented by an attorney. Violations can support a counterclaim that offsets or exceeds the deficiency.
