If Capital One is suing you over a credit card balance, the first thing that matters is the deadline printed on the summons: you generally have 20 to 30 days in state court, or 21 days in federal court, to file a written answer with the court. Miss that window and Capital One can ask for a default judgment, which hands them everything the complaint asked for without ever hearing your side. File on time and you keep every option open: challenging the debt, negotiating a settlement, or, if things are bad enough across your finances, filing for bankruptcy to stop the case in its tracks.
File Your Answer Before the Deadline
The summons tells you which court the case is in and how many days you have to respond. In federal court, the deadline is 21 days from the date you were served.1Cornell Law Institute. Your response is called an answer. You go through each allegation in the complaint and state whether you admit it, deny it, or lack enough information to respond. You also raise affirmative defenses, which are legal reasons the court should rule in your favor even if some of the allegations are true. In credit card cases, the common ones are an expired statute of limitations, an incorrect balance, and missing documentation. If the complaint itself is legally defective, you can file a motion to dismiss instead of, or alongside, the answer.
Filing usually carries a court fee. Amounts vary widely by jurisdiction and can run from roughly $15 to over $400. If you cannot afford it, most courts let you apply for a fee waiver by showing financial hardship or that you receive public benefits like Supplemental Security Income or food assistance. The application is confidential, and approval lets you file without paying.
If You Already Missed the Deadline
When you don’t respond in time, Capital One can ask the court for a default judgment. That means Capital One wins by default. It isn’t necessarily permanent, though. Improper service of process is one of the strongest grounds. If the process server left the papers at the wrong address, handed them to someone who doesn’t live with you, or didn’t follow your state’s service rules, the court may lack authority over you entirely. Defenses That Weaken Capital One’s Case
Capital One carries the burden of proof. It has to show a valid agreement existed, that you owed a specific amount, and that you failed to pay. Each of those pieces is something you can push back on.
Start with the number. Credit card balances get inflated by fees, penalty interest, and sometimes charges that were never authorized. If Capital One cannot produce statements showing exactly how the balance grew from your last known payment to the amount they’re now suing for, that gap works against them. Ask for the original credit card agreement bearing your signature, monthly statements from the account’s history, and a full accounting of charges and payments. Many credit card lawsuits are filed with surprisingly thin paperwork, especially on older accounts. If Capital One cannot connect the original agreement to the amount claimed, you have real leverage.
One more defense worth checking: if the debt was discharged in a prior bankruptcy, Capital One has no right to collect it at all. Check the Statute of Limitations
Every state sets a time limit on how long a creditor can sue over an unpaid debt. For credit card accounts, those limits run from three to ten years, with most states between three and six. If Capital One sued after the clock ran out, you can raise the expired statute of limitations as a defense. Note the word “raise”: a court can still enter judgment against you on a time-barred debt if you don’t show up and assert the defense, so simply knowing the deadline passed isn’t enough.5Consumer Financial Protection Bureau. There’s a Capital One-specific wrinkle. Credit card agreements often include a choice-of-law clause naming which state’s law governs disputes. Capital One is headquartered in Virginia and has historically used Virginia law in its agreements. Whether a court applies your state’s limitations period or the one named in the contract depends on the jurisdiction, so pull out your cardholder agreement and see what it says.
Be careful about resetting the clock. When a Debt Buyer Is Actually the Plaintiff
Not every lawsuit over a Capital One card comes from Capital One. Banks regularly sell delinquent accounts to debt buyers for pennies on the dollar. If the plaintiff is a third-party buyer rather than Capital One itself, you gain another line of defense.
A debt buyer has to prove it actually owns your specific account. That means producing an unbroken chain of sale documents tracing the debt from Capital One to whoever holds it now. Generic bulk purchase agreements that reference thousands of accounts without identifying yours are often not enough. Missing links in that chain can get the case dismissed for lack of standing.
The legal footing also shifts. Negotiating a Settlement
Most credit card lawsuits settle before trial, and Capital One runs dedicated departments for this. A settlement usually means paying less than the full balance in exchange for dismissal of the case. How deep the discount goes depends on the strength of their documentation, the age of the debt, and how clearly you can show hardship.
Lump-sum offers tend to bring the biggest discounts because they guarantee immediate recovery without further collection cost. If a lump sum is out of reach, structured payment plans are common. Get any agreement in writing before you send a dollar, and make sure it states that the lawsuit will be dismissed with prejudice, meaning Capital One cannot refile later over the same debt.
Some courts require mediation or a settlement conference before trial. These put both sides in front of a neutral third party to explore compromise. Even where it isn’t required, you can propose it. Judges generally prefer settlements to trials in credit card cases, and that preference tends to help defendants.
The Tax Bill on Forgiven Debt
If Capital One agrees to accept less than the full balance, the IRS treats the forgiven portion as taxable income. Any creditor that cancels $600 or more of debt has to report it on Form 1099-C, and you’re expected to include that amount on your return.8Internal Revenue Service. Two exceptions matter. Debt discharged in bankruptcy is excluded from gross income entirely. What Capital One Can Do If They Win
A judgment doesn’t pull money from your account overnight, but it hands Capital One collection tools that reach into paychecks, bank balances, and real estate.
Wage Garnishment
Federal law caps garnishment for consumer debt at the lesser of 25% of your disposable earnings or the amount by which your weekly pay exceeds 30 times the federal minimum wage.11Office of the Law Revision Counsel. 15 USC 1673 – Restriction on Garnishment Some states go tighter than the federal floor, so your state’s rules may protect more of your paycheck.
Bank Account Levies
Capital One can also seek a court order to levy your bank account, freezing funds up to the judgment amount. Federal benefits like Social Security and veterans’ payments get special protection. Property Liens
A judgment can become a lien on real estate you own. The claim attaches to the property and generally has to be paid when you sell or refinance. Most states protect a primary residence through homestead exemptions, though the size of that protection varies widely. Liens on non-exempt property can be enforced through a court-ordered sale in some jurisdictions.
Bankruptcy as an Emergency Brake
Filing for bankruptcy triggers an automatic stay that halts Capital One’s lawsuit immediately, along with any garnishment or levy already underway. Chapter 7 wipes out most unsecured debts, including credit card balances, and the discharge usually arrives about four months after filing. The trade-off is that non-exempt assets can be sold to pay creditors, and you have to pass a means test showing your income is below a certain threshold. Bankruptcy stays on your credit report for seven to ten years and makes borrowing more expensive during that stretch. For a single Capital One balance, it may be more than the situation calls for. If the Capital One lawsuit is one of several debts pulling you under, it can be the most efficient reset.
