Can You Get Garnished Without Being Served? Notice and Remedies

Yes, you can be garnished without being served. It happens two ways. A private creditor can obtain a default judgment against you based on service that never actually reached you — sometimes because the process server lied about delivering the papers, sometimes because notice went to an old address, sometimes because a court approved service by newspaper publication that no real person reads. Separately, certain federal agencies can garnish your wages or benefits administratively, without filing a lawsuit or getting a judge involved at all. Which path your garnishment took determines what you can do about it, so the first job is figuring out which one you’re dealing with.

Court Garnishments That Skipped Real Notice

A private creditor — a credit card company, a medical provider, a debt buyer — has to sue you and win before it can garnish anything. Default Judgments

If a creditor sues and you don’t file a response — typically within 20 to 30 days depending on the jurisdiction — the court can enter a default judgment. That judgment awards the creditor the full debt, interest, court costs, and often attorney’s fees, with no hearing and no chance to dispute the amount. From there, the creditor can go straight to a garnishment order. If you never got the summons, the first time you learn about any of this is often when your paycheck shrinks or your bank account freezes.

Sewer Service

“Sewer service” is the practice of process servers falsely swearing they delivered legal papers — the papers, so the saying goes, went into the sewer instead. It is not a hypothetical. Government Garnishments That Never Needed a Judge

Several federal debts follow a completely separate track. No lawsuit, no judgment, no court order. There is still a notice requirement, but the notice is administrative, and if it goes to an outdated address or gets ignored, the garnishment proceeds anyway.

Defaulted Federal Student Loans

If you default on a federal student loan, the Department of Education or its servicer can order your employer to withhold up to 15% of your disposable pay without going to court. The agency must send written notice and offer a hearing before the garnishment starts, but that hearing happens inside the agency. Miss the deadline and it goes forward automatically. What Proper Service Is Supposed to Look Like

Under federal rules, an individual can be served by personal delivery of the summons and complaint, by leaving copies at their home with someone of suitable age and discretion who lives there, or by delivery to an authorized agent.7Cornell Law School. If you were never served, or papers were left with a random neighbor, slipped under the wrong door, sent to an address you moved out of years ago, or simply fabricated, service is defective. Defective service can void the judgment that followed, and voiding the judgment collapses the garnishment order built on it.

Finding Out Who Is Garnishing You

Before you can fight back, you need the paperwork. Your employer’s payroll department or your bank can give you a copy of the garnishment order. That document identifies the creditor and the court that issued it. Pull the court file next — most courts allow online case lookup by name or case number. Inside the file you’ll find the complaint, the affidavit of service, and the default judgment.

The affidavit of service is the document to read closely. It states, under oath, exactly how and where the process server claims to have delivered the summons. If it says you were personally served at an address where you have never lived, on a date you were out of state, or that papers were left with a spouse or roommate who doesn’t exist, you have concrete evidence of defective service.

Getting the Default Judgment Thrown Out

A motion to vacate asks the court to set aside the default judgment and reopen the case. When the ground is that you were never validly served, the judgment is treated as void, and federal rules impose no strict deadline for attacking a void judgment, though you still have to act within a reasonable time. To win, you generally need to show two things: that service was defective, and that you have a real defense to the underlying debt or at least a genuine dispute over the amount. Courts prefer to decide cases on their merits, so putting both pieces in front of the judge strengthens the motion considerably. Useful evidence includes an affidavit stating you never lived at the address where service allegedly occurred, records showing you were somewhere else on the date of claimed personal service, or lease and utility documents establishing where you actually resided.

Claiming Exemptions to Stop the Money Leaving

Vacating a judgment can take time. In the meantime, or as an alternative if you can’t overturn the judgment, you can file a claim of exemption to protect income and funds the creditor legally cannot take. This is a separate filing that targets the garnishment itself.

Deadlines are short. Some jurisdictions give you as few as 10 days from receiving notice of the garnishment. Missing the window can mean losing money you were entitled to keep. Filing fees range from nothing to roughly $140, and many courts waive them if you show financial hardship.

Certain income is off-limits to most private creditors under federal law: Social Security and SSI, veterans’ benefits, federal civil service and retirement benefits, military pay and survivor benefits, federal student aid, railroad retirement, and FEMA disaster assistance. The Automatic Bank Account Lookback for Federal Benefits

Bank account garnishment often lands with no warning. Once a creditor serves the garnishment order on your bank, funds are frozen immediately — sometimes up to twice the judgment amount — and you learn about it afterward, usually when checks bounce and automatic payments fail.

Federal regulation requires the bank, before it does anything else with the order, to check whether any federal benefit payments were deposited to the account in the preceding two months.11eCFR. You don’t have to file anything to trigger this protection. The limit: it only applies to federal benefits arriving by direct deposit. If you deposit paper benefit checks yourself, the bank may not identify the funds as protected, and you’ll need to file a claim of exemption to release them.

Why Speed Matters

Every remedy described here is time-sensitive. Exemption deadlines can run in days. Rule 60 grounds other than void service run out in a year. State deadlines are often shorter than federal ones. Bank freezes tighten the pressure by making rent, utilities, and other automatic payments fail while you sort things out, and money released to the creditor is harder to claw back than money still frozen.

Many legal aid organizations handle garnishment defense for people with lower incomes, and court self-help centers often walk unrepresented filers through the motion to vacate and exemption claim paperwork. The legal system does provide remedies when a creditor cut corners on service or when protected income was swept up. Those remedies just don’t wait for you to notice them.
