Can the Government Garnish Wages for Student Loans?

Yes. The federal government can garnish your wages for defaulted student loans, and it can do it without ever filing a lawsuit or getting a court order. Once a federal loan is in default, an agency can send an order straight to your employer requiring up to 15% of your disposable pay to be withheld and forwarded to the government. One important caveat sits on top of that answer right now: the Department of Education has announced a delay in involuntary collections, so garnishment is paused even though the legal authority to use it is fully intact.{1U.S. Department of Education. When Garnishment Becomes Possible

A federal student loan becomes delinquent the day after your first missed payment and enters default after 270 days of nonpayment.{2Central Research Inc. (CRI). Student Loan Delinquency Default is the trigger. Until then, garnishment is not on the table; after it, the government’s full collection toolkit opens up.

The specific tool is called Administrative Wage Garnishment. Two federal statutes authorize it: 20 U.S.C. § 1095a, which covers student loans under the Higher Education Act, and 31 U.S.C. § 3720D, which lets any federal agency garnish for delinquent non-tax debts.{3Office of the Law Revision Counsel. Private lenders cannot do this. If you default on a private student loan, the lender has to sue, win a judgment, and get a court order before touching your paycheck. The federal government skips all of that.

Is Garnishment Happening Right Now?

The Department of Education has delayed involuntary collections on defaulted federal loans, and that delay covers both Administrative Wage Garnishment and the Treasury Offset Program.{1U.S. Department of Education. U.S. Department of Education Delays Involuntary Collections Amid Ongoing Student Loan Repayment Improvements The pause is administrative, not statutory. The underlying legal authority to garnish is unchanged, and collections can resume once the department lifts the delay. If you are in default now, the practical read is that you have a window, not a reprieve.

How Much of Your Paycheck They Can Take

The student-loan-specific cap is 15% of disposable pay. That number holds whether one loan is in default or five.

Disposable pay is a term of art. It is not gross income and it is not what lands in your bank account. It is what remains after legally required deductions: federal, state, and local income taxes, Social Security, Medicare, and state unemployment insurance. Voluntary deductions do not come out first. Health insurance premiums, 401(k) contributions, union dues, and charitable giving all stay in the pool that can be garnished.{6U.S. Department of Labor. Fact Sheet 30 – Wage Garnishment Protections of the Consumer Credit Protection Act If $200 of every paycheck already goes to your employer health plan, that money still counts as available income under the formula.

There is a floor for low earners. If your weekly disposable pay is at or below 30 times the federal minimum wage, your wages cannot be garnished. At the current $7.25 federal minimum, that threshold is $217.50 per week.{6U.S. Department of Labor. Fact Sheet 30 – Wage Garnishment Protections of the Consumer Credit Protection Act Earn a dollar more than that, and the government can garnish the amount above the floor, up to the 15% cap, whichever is less.

If another creditor is already garnishing your check, the interaction depends on what kind of debt it is. The Consumer Credit Protection Act caps total garnishment from ordinary creditors at 25% of disposable earnings, so a student loan withholding on top of an existing ordinary garnishment cannot push you past that ceiling.{6U.S. Department of Labor. The Notice You’ll Get and Your Right to a Hearing

Before garnishment begins, the government must mail a written notice to your last known address at least 30 days in advance. The notice must state the total amount owed, the intent to withhold from your pay, and your right to inspect and copy your loan records.{3Office of the Law Revision Counsel. US Code Title 20 – 1095a Wage Garnishment Requirement

You have 30 days from the notice date to request a hearing in writing. Filing within that window is critical. A timely request puts garnishment on hold until the hearing is resolved, meaning no money comes out of your check in the meantime. Miss the 30-day deadline and the government can begin withholding while it processes your request.{4Office of the Law Revision Counsel. US Code Title 31 – 3720D Garnishment

Hearings can be held by phone. You carry the burden of proof. The defenses worth raising include:

  • Financial hardship, supported by documentation of income, expenses, and dependents.
  • The debt has already been paid, forgiven, or discharged in bankruptcy.
  • You qualify for a discharge based on total and permanent disability or school closure.
  • You were involuntarily separated from a job and have been reemployed for fewer than 12 continuous months. Garnishment cannot begin during that period.{3Office of the Law Revision Counsel. US Code Title 20 – 1095a Wage Garnishment Requirement
  • You are already making payments under an agreement with the Department of Education or a guaranty agency.

The 12-month reemployment shield is often overlooked. If you were laid off and just started a new job, garnishment is blocked until you’ve held that job for a full year. The agency will not flag it for you; you have to raise it.

Can Your Employer Fire You Over It?

Not for one debt. Federal law prohibits your employer from terminating you because your wages are being garnished for any single debt, and your student loan counts as one debt regardless of how many individual loans sit inside the balance.{6U.S. Department of Labor. Fact Sheet 30 – Wage Garnishment Protections of the Consumer Credit Protection Act The Department of Labor enforces the protection. Once garnishment orders arrive for two or more separate debts, that federal shield falls away.

Wages Aren’t the Only Target

If you’re worried about garnishment, know that two other collection tools can hit before your paycheck does. Through the Treasury Offset Program, the Department of Education can intercept your federal tax refund and apply it to the defaulted balance. You get a written notice 65 days before the offset.{7Federal Student Aid. Student Loan Default and Collections – FAQs Social Security benefits are not protected either. How to Stop Garnishment or Prevent It

Once garnishment starts, it continues every pay period until the debt is paid off or you move the loan out of default. Two paths do that.

Loan Rehabilitation

Rehabilitation requires nine voluntary, on-time monthly payments made within a ten-month window.{9eCFR. Code of Federal Regulations Title 34 – 682.405 Loan Rehabilitation Agreement Those payments are on top of whatever is already being garnished from your wages. When you finish, the default is removed from your credit history and garnishment stops. It takes longer than consolidation, but the credit-report benefit makes it the stronger option for most borrowers who can manage the timeline.

Loan Consolidation

Consolidation lets you pay off the defaulted loan by folding it into a new Direct Consolidation Loan with a fresh repayment schedule, and it’s typically the faster route out of default.{10Consumer Financial Protection Bureau. Should I Consolidate My Federal Student Loans Into a Federal Direct Consolidation Loan Once the new loan is in place, the default status clears and you regain access to income-driven repayment, deferment, and forbearance. The trade-off is that consolidation does not erase the record of default from your credit report the way rehabilitation does, and you can only use consolidation once to resolve a default on any particular loan.

Prevention Through Income-Driven Repayment

The cleanest way to keep garnishment off the table is not to reach default in the first place. Income-driven repayment plans set your monthly payment based on income and family size, and for some borrowers the payment lands at $0.{11Federal Student Aid. Income-Driven Repayment Plans Enrolling before you miss payments keeps every collection tool described above out of reach.

Why Waiting It Out Doesn’t Work

Most debts have a statute of limitations, a window after which a creditor loses the right to sue. Federal student loans do not. The government can pursue garnishment, tax refund offsets, and Social Security offsets for as long as the balance exists, whether that’s five years after default or thirty. Waiting is not a strategy on this debt. If your loans are in default, rehabilitation, consolidation, or paying the balance off are the realistic ways out.
