Which Loans Can Trigger a Refund Seizure
The offset authority reaches federal student loans only: Direct Loans, Federal Family Education Loans (FFEL), and Perkins Loans. When a Loan Becomes Eligible

How to Stop Future Offsets: Get Out of Default
The reliable way to keep your refund is to get the loan out of default. Two options do that: rehabilitation and consolidation.
Loan Rehabilitation
Rehabilitation requires nine on-time monthly payments within a period of ten consecutive months. Payments must be voluntary, reasonable, and affordable, meaning the amount is based on your income rather than your total balance.9Federal Student Aid. The advantage of rehabilitation is that once you complete it, the default notation comes off your credit reports. The catch is that you only get to rehabilitate a given loan once. Loan Consolidation
Consolidation replaces your defaulted loans with a new Direct Consolidation Loan. To consolidate a defaulted loan, you either make three consecutive monthly payments on the old loan first, or you agree to repay the new consolidation loan under an income-driven plan.11Federal Student Aid. Consolidation does not erase the default from your credit history. The old defaulted loan still shows as defaulted, though the new consolidation loan starts clean. Unlike rehabilitation, consolidation can be used more than once, which matters if you’ve already spent your rehabilitation option.
If You Think the Offset Is Wrong
If you believe the amount is wrong, the debt is already paid, or the loan isn’t actually in default, contact the agency that services the debt. Once the refund has been taken, you can still ask the creditor agency to reverse the offset, but you’ll need concrete proof: canceled checks, servicer letters, a payoff statement, or evidence the loan belongs to someone else. If Your Spouse Owes and You File Jointly
Filing a joint return when your spouse has a defaulted federal student loan puts your share of the refund at risk. The entire joint refund can be seized. Processing takes about 14 weeks on paper with the joint return, roughly 11 weeks e-filed with the joint return, and about eight weeks filed by itself after the joint return has been processed. Treat the current delay as borrowed time. Check your loan status through your servicer or at StudentAid.gov.
