Can I Refinance If I’m Behind on Mortgage Payments?

You can refinance if you’re behind on mortgage payments in some cases, but your options narrow quickly as the delinquency deepens. A single 30-day late will not close every door. Once you hit 60 days past due, conventional refinancing is effectively unavailable, and your realistic paths become a government streamline program (if your loan is FHA, VA, or USDA-backed) or a loan modification with your current servicer.

How Far Behind Is Too Far

A missed payment doesn’t hit your credit file the moment it’s late. Creditors generally don’t report a late payment to the credit bureaus until it is at least 30 full days past due. Before that, you may owe a late fee, but the delinquency typically won’t appear in the credit file a refinance lender pulls.

Once a payment reaches 30 days and gets reported, it starts affecting your score and your loan file. A single 30-day late isn’t a universal disqualifier. The hard cutoff for conventional loans is 60 days: Fannie Mae’s Desktop Underwriter system flags a loan as ineligible if any mortgage account shows a payment 60 or more days past due within the 12 months before the credit report date.1Fannie Mae. Falling behind also changes the math. Unpaid amounts accrue additional interest and late fees, which can be added to your principal balance. A higher balance raises your loan-to-value ratio. If that ratio climbs above 80 percent, you’d need private mortgage insurance on the new loan, adding cost.2Consumer Financial Protection Bureau. Conventional Refinance Is Usually Off the Table

A conventional refinance sold to Fannie Mae or Freddie Mac carries the strictest payment-history standard. Under the automated underwriting rule above, a 60-day mortgage delinquency in the last year triggers an automatic ineligible finding.1Fannie Mae. In practice, most conventional refinance applicants need a clean 12-month mortgage payment history.

If your delinquency has already escalated into a foreclosure, deed-in-lieu, or short sale, Fannie Mae imposes waiting periods before you can get any new conventional loan:

  • Seven years after a completed foreclosure. This can drop to three years with documented extenuating circumstances such as job loss or serious illness, with added restrictions on loan type and loan-to-value ratio.
  • Four years after a deed-in-lieu, short sale, or mortgage charge-off, dropping to two years with documented extenuating circumstances.

Government Streamline Programs

If your existing mortgage is government-backed, you may have a more forgiving path. Each program has its own payment-history rule.

FHA Streamline Refinance

The FHA Streamline doesn’t require a full credit check or a new appraisal in most cases. It focuses on whether the refinance produces a clear benefit, such as a lower rate or a switch from an adjustable to a fixed rate.4U.S. Department of Housing and Urban Development (HUD). Your loan must be current at closing — meaning not past due at that point.4U.S. Department of Housing and Urban Development (HUD). Streamline Refinance Your Mortgage Past lates don’t automatically disqualify you. Under HUD’s handbook, the file is downgraded to manual underwriting only if your mortgage shows three or more payments over 30 days late, one or more 60-day lates combined with a 30-day late, or a single payment more than 90 days late within the 12 months before the case number is assigned.5U.S. Department of Housing and Urban Development (HUD). The FHA Streamline carries an upfront mortgage insurance premium of 1.75 percent of the new loan amount.6U.S. Department of Housing and Urban Development (HUD). One caution if you’ve previously used FHA loss mitigation: an FHA partial claim (an interest-free lien holding your past-due amounts) generally comes due when you refinance.7U.S. Department of Housing and Urban Development (HUD). VA Interest Rate Reduction Refinance Loan

Veterans and service members with a VA-backed mortgage can use the VA Interest Rate Reduction Refinance Loan (IRRRL) to lower their rate or switch from an adjustable to a fixed rate.8Veterans Affairs. Interest Rate Reduction Refinance Loan

Federal law imposes two seasoning conditions. You must have made at least six consecutive monthly payments on the loan being refinanced, and the new loan’s note date must fall at least 210 days after the first payment due date of the original loan.9Office of the Law Revision Counsel. 38 U.S. Code 3709 – Refinancing of Housing Loans Both must be met; the later date controls.10Federal Register. On payment history, most lenders applying VA guidelines look for no current delinquency, no more than one 30-day late in the past 12 months, and no 60- or 90-day lates in that window. USDA Streamlined Assist Refinance

If your current mortgage is backed by USDA Rural Development, the Streamlined Assist Refinance skips the credit report, appraisal, and debt-to-income calculation. But the payment-history rule is strict: you must have been current on your existing loan for the full 12-month period before applying, with no defaults during that time.12eCFR. Coming Out of Forbearance

If you entered a forbearance agreement in which your servicer temporarily reduced or paused your payments, your path back to refinance eligibility depends on your loan type and how you handled payments during that period.

For FHA loans, HUD’s handbook says a borrower who keeps paying as agreed under the original note during forbearance isn’t treated as delinquent or late, as long as the forbearance plan is terminated at or before closing. If you stopped paying during forbearance, you’ll generally need at least three consecutive on-time payments after it ends before qualifying for an FHA Streamline.5U.S. Department of Housing and Urban Development (HUD). For conventional loans, the automated underwriting rule applies regardless of forbearance context: a 60-day or greater mortgage delinquency in the past 12 months on your credit report will trigger rejection.1Fannie Mae. DU Credit Report Analysis The safest approach after exiting forbearance is six to twelve consecutive on-time payments before applying for a conventional refinance.

Loan Modification When Refinance Isn’t Possible

When no refinance product fits, a loan modification is often the realistic option. A modification changes the terms of your existing loan rather than replacing it, and it’s designed specifically for borrowers who are behind and can’t meet standard refinance requirements.

Your lender may capitalize past-due interest and fees by adding them to principal, and may extend your repayment period. For FHA-insured loans, HUD allows lenders to extend the term up to 480 months (40 years) from the modification date to reduce the monthly payment.13Federal Register. You apply by submitting a loss mitigation package to your servicer with proof of income and documentation of your financial hardship.13Federal Register. Increased Forty-Year Term for Loan Modifications A modification may be reported to the credit bureaus in a way that affects your score, and some servicers report it as a settlement, which can stay on your credit report for up to seven years. That’s still generally less damaging than a foreclosure, which can block you from a new home loan for two to seven years depending on the program.

FHA borrowers have additional tools. A standalone partial claim moves your past-due amounts into an interest-free subordinate lien that doesn’t have to be repaid until you sell, pay off the mortgage, or refinance. Protections While You Sort It Out

If you’re behind and worried about losing the home while you look at options, federal servicing rules buy you time. Under Regulation X, your servicer cannot begin the foreclosure process until your mortgage is more than 120 days delinquent.14Consumer Financial Protection Bureau. Once you submit a complete loss mitigation application, more protection kicks in. If the application arrives before any foreclosure filing, the servicer can’t start foreclosure until it has evaluated the application, sent you a written decision, and you’ve either been denied (with any appeal resolved), rejected all offered options, or failed to perform under an agreed plan. If foreclosure has already been filed but the sale is more than 37 days away, a complete application halts the sale until the same evaluation is complete.14Consumer Financial Protection Bureau. The practical takeaway: ask your servicer for help rather than shopping a refinance elsewhere.

Refinancing During Chapter 13 Bankruptcy

Refinancing while in an active Chapter 13 is possible in limited circumstances, but it requires court or trustee approval. In a Chapter 13, you propose a repayment plan of three to five years that lets you catch up on mortgage arrears while making regular payments. A refinance during the plan typically requires that you be current on plan payments, that the new loan only refinances existing debt secured by your home, that all existing liens be paid from the refinance proceeds, and that the new monthly payment not exceed the current one.

You’d file a motion with the bankruptcy court or get written consent from the Chapter 13 trustee. Because the requirements are strict and approval adds time, this route works best when rates have dropped enough to justify the effort.
