The cardholder agreement is with Evolve Bank & Trust. Failing to pay the statement balance by the due date puts your account in default. The agreement allows the bank to sue for the balance and requires you to pay court costs and attorney fees if it does. What Happens After You Close With a Balance
During closure, Earnin gives you the option to cancel any pending debits that haven’t yet been sent for processing. You can cancel them and still close the account. How to Close the Account

- In the app, tap the triple-bar menu (≡) at the lower right to open Settings, tap your profile, then tap “Close My Account” and follow the prompts.

The flow will show you any pending debits and ask whether you want to cancel them. If a debit has already been sent for processing, it will run as scheduled. If you’ve been using the Tip Yourself savings feature, pull those funds out before you finish closing. Stopping the Debit Through Your Bank
If you need to block the debit itself, federal law gives you the right to do so.
