Yes, a creditor can get a judgment against you without your knowing about it. Why the Papers May Never Reach You
Sewer Service
“Sewer service” is the term for a process server filing a sworn affidavit claiming they delivered the papers when they didn’t. Investigations have caught servers logging physically impossible routes, like serving two addresses miles apart within minutes, and describing defendants of the wrong sex or race. It is perjury and a fraud on the court, but the affidavit looks legitimate on its face, so the court accepts it and the default clock starts.
You Moved
Creditors sue using the last address they have on file. If you moved and never updated the creditor, the server may deliver to a place you left years ago. Service at a former residence can still be treated as valid, and the creditor did nothing wrong on paper. You just weren’t there.

Substituted service depends on a roommate, family member, or partner actually handing you the documents. Most people find out about a default judgment when collection starts. By then it may be weeks or months old.
- Your bank account freezes. A judgment creditor can serve a levy on your bank, and federal law only requires the bank to notify you in narrow situations involving protected federal benefit payments. - Your paycheck shrinks. You Also Need a Defense to the Debt
Courts don’t vacate judgments just because service was flawed. You have to show a legitimate defense to what the creditor claims you owe. Not a guarantee of winning, but enough of a case that a trial is worth having. “I can’t afford to pay” isn’t a defense. “I already paid this,” “this isn’t my account,” or “the amount is wrong” are. When you file the motion, you typically include an affidavit explaining your absence, evidence supporting your service challenge, and a proposed answer to the original complaint. If the judge grants the motion, the judgment is canceled, active garnishments and levies stop, and the case resets to the start.
The Statute of Limitations Angle

How to Reduce the Risk
Keep your address current with every lender, card issuer, and service provider you owe money to. Creditors send demand letters before they sue, and those letters are your warning. If you move, put in a mail forwarding order.
If a summons and complaint do reach you, file an answer by the deadline printed on the summons, even if you think the debt is wrong, too old, or not yours. Answering preserves every defense you have.
