Autovest LLC Garnishment: Exemptions, Defenses, and Settlement

If Autovest LLC is garnishing your wages or has frozen your bank account, a court has already entered a judgment against you, and you are now in the enforcement stage of a collection lawsuit rather than a demand-letter stage. An Autovest LLC garnishment can be stopped or reduced through several routes: filing a claim of exemption for protected income, moving to vacate a default judgment, attacking the underlying auto deficiency, negotiating a settlement, or filing bankruptcy. The window to act is short, often ten to twenty days from the notice, so the order in which you move matters as much as which move you pick.

Who Autovest Is and Why That Matters to Your Strategy

Autovest did not lend you money. It buys defaulted auto loan debts from banks, credit unions, and finance companies for a fraction of face value, then sues in its own name to collect the full balance. The debt almost always traces back to an auto loan deficiency: the gap between what you still owed and what the lender recovered when it repossessed and auctioned the car. If your vehicle sold at auction for $8,000 and you owed $15,000, that $7,000 shortfall (plus fees and interest) is the kind of balance Autovest buys and pursues.

Two facts follow from this that shape everything below. First, because Autovest bought the debt cheaply, it has room to settle for far less than the judgment and still profit. Second, because it usually collects through default judgments entered when the debtor never appeared, the paperwork behind the garnishment is often vulnerable to challenge.

How Much Autovest Can Actually Take

From Your Paycheck

Wage garnishment is an ongoing order to your employer to withhold part of each paycheck. Federal law caps the take at the lesser of 25% of your disposable earnings, or the amount by which your weekly disposable earnings exceed 30 times the federal minimum wage of $7.25 per hour. Disposable earnings are what remains after mandatory deductions like taxes and Social Security, not your gross pay.1U.S. Department of Labor. In practical numbers, if your weekly disposable earnings are $217.50 or less, nothing can be garnished. Between $217.50 and $290, only the amount above $217.50 can be taken. State law often gives you more protection. Texas, Pennsylvania, North Carolina, and South Carolina prohibit wage garnishment for consumer debts entirely. Others cap the take at 10% to 20% of disposable income or use income-based brackets. Whichever law protects more of your pay is the one that applies.

From Your Bank Account

A bank levy is different. Rather than an ongoing paycheck deduction, Autovest serves a writ on your bank, and the bank freezes whatever balance is in the account when the writ arrives. It’s a one-time snapshot; future deposits are not swept unless Autovest gets a new writ.

Federal regulations require banks to automatically protect two months of direct-deposited federal benefits from any garnishment order, without any paperwork from you. What to Do in the First Days After the Notice

Treat the deadline on the notice as the most important date on your calendar. Miss it and the frozen funds are released to Autovest without a hearing, and the wage withholding continues without review. Response windows are usually ten to twenty days depending on the state.

Read every page of what you received. The garnishment papers list the case number, the issuing court, the amount claimed, and the deadline to object. If any of that is unclear, call the clerk of the court listed on the paperwork; clerks can explain procedural steps but cannot give legal advice.

Your response usually involves two filings with the court clerk, with copies served on Autovest or its attorney. One is an Answer to the garnishment, formally acknowledging or disputing it. The other is a Claim of Exemption if any of the funds or wages at issue are legally protected. If your income comes entirely from exempt sources like Social Security, file the Claim of Exemption first; it is the fastest way to release money.

Claiming Exemptions to Release Protected Funds

Certain income is off-limits to creditors like Autovest. States commonly add exemptions for unemployment benefits, workers’ compensation, disability payments, and a portion of wages needed for basic living expenses. Some offer a wildcard exemption that protects a set dollar amount in a bank account regardless of source. The amounts and rules vary. Look up your own state’s list before you file.

Vacating a Default Judgment

If the garnishment rests on a default judgment, meaning you never appeared to defend the original lawsuit, you may be able to have the judgment thrown out by filing a motion to vacate. Kill the judgment and the garnishment dies with it; Autovest would have to start over, this time with you in the courtroom.

Two grounds tend to succeed together. The first is improper service, where the process server left the papers at the wrong address or with someone who didn’t live with you, so you never actually received notice of the suit. The second is a meritorious defense, meaning you have a real argument against the debt if the case is reopened. Most courts want to see both. Time matters: the longer you wait after learning of the judgment, the harder the motion becomes.

Attacking the Underlying Deficiency

Commercially Unreasonable Sale

When a lender repossesses and sells a car, every aspect of the sale — method, timing, manner, and terms — must be commercially reasonable. Statute of Limitations

The lender or Autovest had a limited window to sue on the deficiency, typically three to six years from the default or repossession depending on the state. A suit filed after that window may have produced an improperly obtained judgment. Federal law also bars debt collectors from suing on time-barred debts. Compare the original default date to your state’s limitations period, particularly if the judgment was entered by default.

Chain of Ownership

Autovest has to prove it actually owns your specific debt. Portfolios pass through multiple hands, and paperwork gets lost. If Autovest cannot produce the original loan agreement, a clean chain of assignment from the original lender, and an accurate accounting of the balance, that is a real basis to challenge the judgment.

Settling With Autovest

This is the leverage most people miss. Because Autovest paid pennies on the dollar for the debt, it can accept significantly less than the judgment amount and still profit. Debt buyers routinely settle for 20% to 50% of the balance, sometimes less on older debts. Settlement is possible after judgment; Autovest would generally rather have a lump sum now than chase garnishment payments for years.

Get every term in writing before any money changes hands. The written agreement should state the exact amount, confirm the debt will be reported as settled or paid in full, and require Autovest to file a satisfaction of judgment with the court. Pay by cashier’s check or money order. Never give a debt collector direct access to your bank account. Be aware of the tax consequences below before you sign.

Using Bankruptcy to Stop Garnishment Immediately

Bankruptcy is the fastest way to halt a garnishment. The moment you file a petition under Chapter 7 or Chapter 13, the automatic stay under federal law prohibits all collection activity, including garnishments, bank levies, lawsuits, and phone calls.5Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay Once your employer is notified of the filing, the withholding stops.

Chapter 7 can discharge the auto deficiency judgment entirely, leaving you owing nothing. Chapter 13 folds the debt into a court-supervised three-to-five-year repayment plan, often at a reduced amount. Bankruptcy has costs, affects your credit, and requires a mandatory credit counseling course, so it usually makes sense when the total debt is large or you have multiple debts stacked up. For a lone auto deficiency, the other strategies here are less disruptive.

FDCPA Violations as Leverage

Autovest is a debt collector under the Fair Debt Collection Practices Act. Violations during collection can produce a counterclaim with up to $1,000 in statutory damages, plus actual damages and attorney’s fees. Even where a violation does not by itself dissolve the garnishment, it gives you bargaining power at the settlement table. Keep every letter, voicemail, and court filing you have received from Autovest.

The Tax Bill if the Debt Is Forgiven

If Autovest settles for less than you owe, or cancels any portion of the balance, the IRS may treat the forgiven amount as taxable income. Autovest is required to send a Form 1099-C for cancelled debt over $600, and you would owe tax on that amount as though you earned it.

The insolvency exclusion is the usual escape. When the Judgment Expires

Judgments do not last forever, though they last longer than most people expect. Enforcement periods run anywhere from 5 to 20 years across states, with 10 years being the most common. Most states let the creditor renew the judgment before it expires, resetting the clock, and Autovest can keep renewing as long as it files on time.

If the judgment behind your garnishment is at or past its expiration and Autovest has not renewed it, the enforcement may be challengeable. Pull the original judgment date from the court file and compare it to your state’s enforcement period. An expired, unrenewed judgment is unenforceable, but courts will not raise this on their own.
