Retirement accounts are generally protected from creditors, but whether your specific account is safe depends on four things: the type of plan, whether you’re in bankruptcy or facing an ordinary judgment, the state you live in, and the kind of debt at issue. Employer plans covered by ERISA get the strongest shield with no dollar cap. Traditional and Roth IRAs are protected in bankruptcy up to a combined $1,711,975, and outside bankruptcy their safety turns almost entirely on state law. A short list of debts, including federal taxes, divorce orders, and criminal restitution, can pierce even the strongest protection.
401(k)s, Pensions, and Other ERISA Plans
If your retirement money sits in an employer-sponsored plan governed by the Employee Retirement Income Security Act, you have the best creditor protection the law provides. Two separate rules do the work. In bankruptcy, ERISA-qualified assets are excluded from your bankruptcy estate entirely, with no dollar cap. IRAs in Bankruptcy
Traditional and Roth IRAs are also protected in bankruptcy, but with a ceiling. The combined value of all your Traditional and Roth IRAs is exempt from your bankruptcy estate up to $1,711,975. That cap took effect April 1, 2025, and applies to cases filed through March 31, 2028; the figure adjusts for inflation every three years.2Office of the Law Revision Counsel. 11 USC 522 – Exemptions It is a per-person total across all your IRAs, not a per-account figure. Anything above it goes into the bankruptcy estate.
One exception matters a great deal. Dollars rolled into an IRA from an employer plan do not count toward the $1,711,975 limit. Rollover funds keep the unlimited protection they had inside the employer plan, so even a large IRA balance may be fully safe if enough of it is traceable to a rollover. Traceable is the operative word. You need to prove which dollars came from the employer plan, which means holding on to Form 1099-R from the distributing plan and Form 5498 from the receiving IRA.4Internal Revenue Service. IRAs Outside Bankruptcy
If a creditor sues you, wins a judgment, and you don’t file for bankruptcy, federal bankruptcy exemptions don’t apply. Your protection comes from state law, and the range is wide. Some states shield IRAs without any dollar limit. Others protect only the amount “reasonably necessary for support,” which lets a court decide how much you actually need for retirement and expose the rest. A few set specific dollar caps, and several disqualify IRA contributions made within a set window before a claim, often 120 days, as a safeguard against last-minute sheltering.
ERISA plans are different. The federal anti-alienation rule operates independently of the bankruptcy code, so a judgment creditor still cannot garnish your 401(k) or pension while the funds remain in the plan.3U.S. Department of Labor. If you rely on IRA assets as a financial safety net, knowing your state’s specific rules is the most important step you can take.
Self-Employed Plans
Self-employed savers face two very different outcomes depending on which plan they use.
SEP IRAs and SIMPLE IRAs are treated better than their “IRA” label suggests. The federal bankruptcy code explicitly carves simplified employee pensions under IRC section 408(k) and SIMPLE accounts under section 408(p) out of the $1,711,975 cap.2Office of the Law Revision Counsel. 11 USC 522 – Exemptions The result is unlimited bankruptcy protection, similar to an ERISA employer plan.
Solo 401(k)s are the trap. Because they typically cover only the business owner and possibly a spouse, they generally fall outside ERISA. Inside bankruptcy, a solo 401(k) still gets protected as a tax-exempt retirement fund. Outside bankruptcy, though, the anti-alienation shield doesn’t apply, and you fall back on state law. Many states do protect these accounts, but the coverage is neither automatic nor uniform.
Inherited IRAs
The protection picture changes sharply when a retirement account passes to someone other than the original owner. In Clark v. Rameker, the Supreme Court held that an inherited IRA held by a non-spouse beneficiary is not “retirement funds” for purposes of the federal bankruptcy exemption.5Cornell Law Institute. Clark v Rameker Supreme Court Bulletin The Court pointed out that inherited IRA holders can’t add new contributions, must take distributions regardless of age, and can withdraw the full balance any time without penalty. The account looks more like accessible wealth than protected savings.
The consequence is blunt. If you inherit an IRA from a parent, sibling, or anyone other than a spouse, that account is part of your bankruptcy estate and available to your creditors. A few states shield inherited IRAs from creditors outside bankruptcy, but that remains a minority position.
The Spousal Rollover
A surviving spouse has a way to restore full protection. A spouse who inherits a retirement account can roll it into their own IRA or elect to treat it as their own.6Internal Revenue Service. Retirement Topics – Beneficiary Once the rollover is done, the account is treated as the surviving spouse’s own retirement fund and gets the same federal and state protections as any other IRA. Unless there’s a specific reason to keep inherited status, such as needing penalty-free access before age 59½, the rollover is usually the right move.
Trusts for Non-Spouse Heirs
For children and other non-spouse beneficiaries, estate planners work around Clark by naming a specially drafted trust as the IRA beneficiary rather than the individual. When the trust includes spendthrift provisions, the beneficiary’s creditors can’t reach the assets before the trustee distributes them. This kind of planning needs an attorney familiar with both retirement accounts and trust law, but it remains the primary tool for protecting inherited IRAs from a beneficiary’s creditors.
Debts That Can Reach Protected Accounts
Even the strongest shield has holes. Certain categories of debt cut through retirement account protection because Congress or the courts decided collection outweighs preservation.
Federal Taxes
The IRS can levy retirement accounts, including 401(k)s, IRAs, and pensions, to collect unpaid federal taxes. The authority comes from IRC section 6331, which lets the IRS levy on essentially all property and rights to property.7Taxpayer Advocate Service. Protect Retirement Funds From IRS Levies In practice the IRS follows an internal policy of not levying retirement accounts unless the taxpayer has engaged in flagrant conduct such as deliberate tax evasion. That’s an internal guideline, not a legal prohibition, and the agency keeps the authority to levy when it decides the situation calls for it.
Divorce, Child Support, and Alimony
Family law obligations are the most common way retirement money gets divided. A Qualified Domestic Relations Order, or QDRO, is a court order that directs a plan to pay part of a participant’s benefits to a spouse, former spouse, or dependent child.8Internal Revenue Service. Federal Criminal Restitution
Federal criminal restitution orders can reach accounts that would otherwise be untouchable. Under 18 U.S.C. § 3613, the government can enforce a restitution judgment against “all property or rights to property” of the defendant, and the statute explicitly overrides other federal law, including ERISA’s anti-alienation protections.9Office of the Law Revision Counsel. 18 US Code 3613 – Civil Remedies for Satisfaction of an Unpaid Fine Retirement accounts are not among the exempt categories under this section. A 401(k), IRA, or pension can be garnished to pay federal restitution.
Fraudulent Transfers
Courts can strip protection from contributions made with the intent to hide assets. If you drop a large sum into an IRA or 401(k) shortly before filing bankruptcy or while a lawsuit is pending, a court may treat the contribution as fraudulent and order the funds returned. A steady, long-standing pattern of contributions looks nothing like a sudden deposit that lines up with a looming judgment. Some states also disqualify contributions made within a set window, often 120 days, before a claim. The point of retirement account protection is to preserve genuine retirement savings, not to serve as a last-minute hiding place.
Steps to Maximize Your Protection
A few decisions can meaningfully improve where you stand.
Favor ERISA-qualified employer plans when you have the option. The mix of unlimited bankruptcy protection and the anti-alienation rule makes a 401(k) or 403(b) stronger than an IRA from a creditor standpoint. If you’re self-employed, remember that a solo 401(k) lacks the anti-alienation shield outside bankruptcy, and check whether your state fills the gap.
Document every rollover. Rollover dollars keep unlimited bankruptcy protection only if you can prove where they came from. Hold on to Form 1099-R from the distributing plan and Form 5498 from the receiving IRA, and keep them indefinitely.4Internal Revenue Service. Know your state. If you live somewhere with limited IRA exemptions and you hold substantial IRA balances, that’s real exposure. You can respond by maximizing employer plan contributions instead, by restructuring how assets are held, or simply by going in with your eyes open. State rules in this area vary enormously, and what protects you in one state may not protect you at all in another.
